I looked at that already. Very confusing to read...I can't seem to find the section that pertains to mods and whatnots.

Keiho, you've got to read the whole thing to find the bits you want.

"Clearance of motor vehicles

Section 205 - A person must not operate on a highway a motor vehicle designed or modified so that a portion of it, other than the wheels in contact with the roadway, has less clearance from the surface of a level roadway than the lowest point on the rim of any wheel in contact with the roadway.

Ashton, well done on picking this link out.

There are lots of places in the act where modifications are mentioned. You just have to hunt around.

The act does state clearly that the police are entitled to issue an inspection notice. This right bears no responsibility. They do not have to have a reason. They do not have to state what is to be inspected. The operator of the vehicle is obliged to obey the notice, and the vehicle can only be used if it is approved after inspection.

All in all, the act is badly worded, full of holes, open to abuse (by the police) and probably easily argued against in court. Sort of fits with the BC government, just there to make it look they are doing something but really only provides another mechanism for making the public fork out money for no good reason or purpose.

As far as inspections go the act spends all of its time describing how inspection facilities will be regulated (more $$$$$ for the government).

If I get one of these inspection notices, I'm going to ask the officer to clarify the reason for the inspection.

If they do not provide reason(s), I'll fight it on harrassment. If they do and it is not specifically in the act, I'll fight it on justification. If it is in the act, I'll have to stand by the inspection notice. Whatever, it places the responsibility on the officer to not just be an a$$6@le. I hope I remember to ask nicely though.

BTW, I think the cops here are pretty good. I would be happy to see them putting a stop to incidents like the one on Knight Street. However, lurking in the bushes for a car with a wing and stickers is easy meat for bullies and nothing more.

+ #2 you only have to watch the speed trap outside the Park Royal mall to see that the young rice boy is guaranteed to be pulled, mums in vans are #2, the old fart in the Merc is last in line. Everyone is above the posted speed limit (even the buses) so it comes down to cherry picking whoever they want. At least outside the schools in the morning they book anyone for speeding (well done there).

I've gone on too long. Sorry.

Guess I've got a bit of reading to do tonight then.

But that's what I've been thinking Petrie, the fact that he was hiding in the bushes at 2 in the morning on a deserted road by the airport. I don't mind getting pulled over, hey, they must have a reason to, but come now, 2 in the morning on a deserted road when there are other definitely more pressing concerns happening elsewhere. That's ridiculous.

In the UK, the cop must prove that he had reason to stop you, or it's an illegal stop. If he sees you leave a pub and drive away, that's a reason. If you're speeding, that's a reason. So what was this guy's reason for picking on you? If it was speeding he should have given you a ticket!

I completely disapprove, in every way, with the situation that led to the death of that guy on Knight Street. For me, it was intentional assault with a deadly weapon. The soon it disappears from our streets the better. That goes for all the stupid behaviour that (by chance on a particular day) does not result in an accident.

If he stopped you, checked, and let you go fine, but what's with the widening the outlet? Search the act for that one. I say get some advice, I think this guy has made that charge up.

Louder is covered by the act, but the size of the opening ? (it's so badly written I could have missed it)

I think, like the other post, it will go away in a few months. Like the politicians, they have to show that they are increasing the clamp down on boy racers. In a nut shell, you got pulled for what might be $500, because you've got stickers on the hood and drove after dark.

To be honest, I haven't a clue why I was pulled over, he didn't say. First thing he said to me was if I knew what the speed limit was, to which I replied that I honestly haven't a clue. And yes, I WAS speeding. I was prepared to get a speeding ticket, which I admit I was doing. But then he proceeded to grill me over my mods, and no, I don't even have that many stickers. Just an I-Club sticker, and a couple small ones that are barely noticeable.

I've already decided to dispute the two fines regarding the outlet opening and the clear corner, but the vehicle inspection is what annoys me.

Ok, I've done some research into this, practically read the MVA, and the Motor Vehicle Safety Act and regulations. Basically the only things that relate to car mods are: having a cat, lowering of car, seat belts. I don't see anywhere anything that mentions exhausts, lights, clear corners, etc...

Has anyone else tried any other means of finding the information? I've read the articles, been to the library...does anyone know a lawyer?

Keiho,
http://www.icbc.bc.ca/forum/forum.cgi

Try the above forum. There is an RCMP officer (Tim) who frequents there and posts good advice. Just don't say you want to fight a ticket Also, read the posts first. I remember reading some that pertain to your situation.

Good Luck!
