Default Tickets: anyone ever have luck with a trial by declaration?

So I got my ticket which I hoped never to receive, it's for $436. It seems like the cop used his discretion in making it such a large fine, the minimum would've been $150.

I was wondering whether anyone has had success or experience challenging a ticket in a trial by declaration. I think this cop is pretty lazy and might not really respond to anything written, he wrote the ticket wrong and was really slow filing the ticket (took 3 months), and the court is about 30 miles away and would require taking off half a day if I went.

Whats the ticket for? My dad once got off a 68 in a 35. But it all depends on where you got the ticket and what its for and who the judge is.

Ticket was on 101, southbound, near San Mateo/Redwood City. So it'll be the judge at the San Mateo traffic court. Thinking a written declaration isn't going to work, so I better try for the appearance thing.

In 1997 I got a ticket in Springfield, Oregon. Not wanting to drive from the Bay Area to Oregon for a court appearance, I tried trial by declaration, wrote my statement, got it notarized and mailed it in.

When my day in court came, they read my declaration, but the cop was there in person and refuted all my claims.

I got the book thrown at me, it would have been cheaper and easier to just pay the fine.

Unless you plan on showing up for the court date in person, it's not worth contesting the ticket. In my opinion, take the 1/2 day off from work and deal with it.

As for the ticket, I'd say plead not guilty and show up to court. If you lose, ask for traffic school.
