Unhappy Part II: I should have called the cops that night.....

Well if people remember my story about my neighbor lighting off fireworks 30' away from my house here the thread to catch you up:

http://forums.nasioc.com/forums/show...arded+neighbor

This afternoon I went to Wal Mart to pick up some automotive stuff, and as im pulling into my driveway I noticed my parents talking to one of my dad's tenants friends whos there everynight who hangs out with him, he usually parks his car in front of his house in the street.

The first thing I notice as im pulling in is that there looking at his car with my mom, my dad, my dad's tenant and his friend.

So I pull up and park, get out of my car and walk over to see what there talking about...

So me, my dad's tenant, and his friend were talking about the burn marks that are all over the roof of his car and his hood, I started looking at his car and there it was some very small burn marks in his paint on the hood and roof of his car.

They told me they heard me telling my neighbor to stop with the fireworks so it doesnt cause any damage to my property. They said after I told them to quit it, they went down the street, lit off a few more, then came back in the same area and started lighting them off in the same area!

The way that my dad's tenant's friend's 3 month old celica was parked, my neighbor must have been lighting off the fireworks at least 10'-13' away from his car in the street!

So heres what they did, they approached the lady who was with my neighbor mike who was the one who was lighting off the fireworks that night, both my tenant and his friend approached her, they showed her the damage to his celica, noted that it was caused by shooting off the fireworks so close to his car. All she said was "Sorry about that, we will stop", they didnt get a chance to talk to my neighbor Mike since he wasnt home.

I was planning on washing my car today, so as I was putting the wax on my car I started noticing all thease very small burn marks on my cars hood, and my roof! As im working on the rear end of my car I notice this big fat burn mark! Its about 3/16" to 1/4" in diameter, and very small bubbling action with it!

So I grab my dad's tenant with his digital camera, and we start taking pictures of the burn marks that are on my car, and his friends Celica.

I guess the next thing we're going to do is register mail a letter to both the lady across the street from me and Mike who was the one physically lighting off the fireworks that night to see what there responce is going to be.

If not we're going to get our cars estimated for repair and see if we cant take this thing to small claims court.

I asked my dad since he is very familiar with legal issues, he told me I should have called the police that night to recieve a police report about the incident, and that it did occur. Thus even though I saw it (and tried to stop them), my dad's tenant, his friend, and 2 other people that saw how many fireworks they were lighting off, who are willing to testify about it, that it might be harder to get the judgement w/o a police report.

We also have fireworks remains on our front lawn, so we took pictures of where they were and placed them in a plastic bag.

So If anybody has helpful advice of how to handle this, by all means please let me know.

Edit:

I just talked to my dad's tenant and hes going to get a hold of his friend with the Celica and we're going to try to see if we can still file a police report so at least we have something on paper about this.

People are so stupid with fireworks. I'm glad they are banned in MA seriously it would be a lot worse I think. Good luck on the car and police report man.
