Default Another I was pulled over thread (x-post from I-club)

From 9-01-03:

So I got pulled over about 40 minutes ago. This is on 280N near 380. The officer pulls me over for speeding which I'm going maybe 75-80mph. He askes about my stromung, has me rev it a little and says he thinks it's a little loud.

Anyhow, as luck would have it a pursuit passed by going on the opposite side of the freeway. The officer comes back and says, "okay boss, I have to catch up to the pursuit that you just saw. You'll get a citation for speed and the exhuast in the mail in one to two weeks." Then he just gives me back my license, registration, insurance and leaves to join the pursuit.

Am I really gonna get something in the mail? I got no ticket and I signed nothing. I thought I had to actually sign any kind of ticket that I get. Other than that, I guess I should pray that he doesn't file the paperwork.

Today:

I get my ticket in the mail.

Anyone have any advice on this one? Someone said someone named Soya would know? I'm not sure if I have a case here, I checked out the vehicle code and there was never any specific mention of driver signatures being required.

I'd say you definitely have a very good chance of fighting it. I don't have a copy of a ticket on me, but if you can get a hold of one, read what it says on the bottom and that should help you out.

Hey there. I don't know much about exhaust tickets, but if you give me the section of the vehicle code that he wrote you up on I can look into it.
As for the speeding ticket the first thing to look for is what section he wrote you up under. If it's 22350, the basic speed law, you're in luck because it's beatable. If you have the time and the interest go to helpigotaticket.com and read just about everything on there that relates to 22350. If you feel comfortable use that information to write up your trial by declaration. Otherwise, pay the fee at ticketassassin and use one of their canned versions. It's worth noting that if you're eligible for traffic school it is a less risky option. If you file a trial by declaration you lose the traffic school option, although you can still take the citation to court.

I did some follow up on exhaust noise citations. The bottom line is that, thanks to SEMA, legislation was passed recently that allows you to get your exhaust tested at some places that do smog testing. To find the locations call the bureau of automotive repair here: (800) 952-5210.
The legal limit is 95 dBs. Here's a story about a guy with a Blitz that passed so I imagine your Stromung should be fine:

Actually the only thing listed on my courtesy notice is VC-22349A, exceeding maximum speed limit of 65MPH.

I didn't say anything about the exhaust. Though when I was talking to him he told me the same thing about getting it tested.

I imagine that means you're off the hook for the exhaust citation. 22349 is actually pretty tough to beat. It's a bright line rule-- if you're above 65 you're guilty. If he used radar you might have a shot because there are a number of procedures the cops must use to calibrate the radar (search this forum for radar for more info). But, if he paced you it would pretty much be his word against yours, which in most cases means you lose. I'd go to traffic school if it's an option. If not I'd still do trial by declaration and follow it up in court on the off chance that the Chip won't follow up.

hey alan so you got the ticket eh? well i got the same ticket, minus the cop giving me grief about my exhaust. i was ticketed for 80 in a 65.
im taking traffic school now. that thing is irrating, especially on dial up. ive already spent 7.5 hours and im just on chapter 11. that thing logs me out so many times...and gives me errors alot. it sometimes even takes me 4 mins just for the next page to load. hope you dont have a dial up.

yeah, i'd go with soya's advice. IMO you should really be able to get off. go to www.ticketassassin.com and use the letter they have to explain to the judge the circumstances of the ticket. i would put money on the fact that you should get off. i would do written declaration (don't forget to sign the letter before you send it), and if you lose that, appeal it and plead not guilty and request traffic school, but there's a good chance the chip will either have transferred or screw up by that point in time. whatever you do, don't just pay the find and take the point. YOU DO NOT WANT A POINT. good luck.

just curious, how where can you find out if you ahve any points on your driving record? ive gotton a few tix a while back and went to driving school for one of them?

Since we're on the topic of traffic tickets... is it legal for Newark PD to setup a speed trap in UC/Fremont?
I've seen the Newark PD setup on Paseo Padre (Union City/Fremont side) trying to get commuters taking the back way to the Dumbarton Bridge.

In the article it said his exhaust was at something like 88.1 decibles. I sure Chow just plugged his silencer into his blitz Nur Spec. It cuts the sound level in half. The Blitz ehaust, without the silencer is one of the loudest.
