Post want to get out of this ticket

I was going too fast in a special zone between sonoma and napa first weekend in 2001. Got a ticket for 100mph. I saw the officer turn on his lights before he passed me. I knew he was gonna pull me over, he was following 3 other cars. I was already below the speed limit by the time he made his u-turn. I was on the side of the road before he caught up to me. So technically he didn't pace me. Also there was a car behind me, that I had just passed. Normally I would just request traffic school (cause I was speeding, but not doing 100mph). However I want to try and get out of it. It would/will be my first time trying to defeat a ticket. Any help would be appreciated. I have not taken driving school since late 1998.

I don't suppose you asked the kind officer to see his radar/laser readout showing that you were speeding.. or asked for proof of calibration of the thing.

Just request to go to the court. If the officer show up, ask the judge to go to traffic school before arguing the ticket. If the officer didn't show up, you win. I won my last two tickets because the officer didn't show up.

I just recieved my Bail Refund check today from Napa Superior Court. I fought a ticket I got in September while driving to Lake Berryessa.

But, yours sounds a little trickier.

I was with my brother last year in his '93 Cobra when we passed a parked CHP @ 130mph. DOH! We pulled over right away, he didn't even turn on his lights. He told my brother to come look at the Radar. It was flashing 100+...100+...100+. The CHP said, that is as high as they go, after 100mph they give you the benefit of the doubt. That was in Sonoma County, Adobe Road (2 lanes only).

Oh yeah, he lost his license for a month.
No chance for Traffic School. Too Fast.

The officer can "show up" by giving a deposition, so it's not always a given.

As long as he doesn't have you on radar you should be OK.

The problem is a lot of those police cars can shoot radar in the opposite direction!

Was this a CHP? if so, forget it, he will make his case one way or the other. They have to. Now if it was a local you might try the "if he/she show's up" approach. Keep in mind, chances are if you try to argue it with the officer there, 92% of cases go to the officer in the state of california. Good Luck!

i konw as a fact that if the cop was driving they can't use the lazer (not sure bout radar). since the "beam" hits and bouces back off your car to the gun it gets ur speed from that old formula. distance/ time= speed. so if the cop is traveling they can't get your correct speed what so ever.

also police cars need to be calibrated. where they put the car on a dyno and see the diff between wheel spin and the odometer.

if he says he saw u. throw a pen across the court and ask him how fast that was going.

told someone else bout it on the board. but it works.

you can bring pics of your car in too, show the judge, explain that ppl are bias. bring ing your clean abstract. build a case for your self!!!!! and repeat the fact bout the other car, the cops original direction, and STATE any comments of what the cop said bout the car like "whats up with the scoop, spoiler, rims, exaust... cops are bias too ya know. state how long it took him to pull you over. use street names, signs, pictures, how much traffic, type of road how bumpy, curvy it was, create a visual for the judge for the distance.

you also have a right to see the ticket since it is a form of evidence. on the back they write notes. like anything you said. or just stuff so they can remember you.
do all this and tell me how it goes in a month.

if u do it write and have good driving habits u should do good.

most of all deny everything!! don't even say i wasn't going that fast. " i saw the officer from about 400 ft away and looked down to make sure my "cruise controle" was set properly at 55 (or what ever) so there was no way i could have gone over the speed limit. also the car behind me which happen to be a "ford escort" (geo metro) was keeping an even distance between the officer and i. i belive he felt that i was a racer type driver and pulled me over. blah blah blah... the stop was uncalled for, and unjust. and i wish to have it dissmissed with no record.

They can clock you with radar while traveling in the opposite direction. They simply subtract their speed from the readout on the radar. I think they even have some systems that are hooked into the cars speedometer and will do the subtraction for them. You can argue the accuracy of the radar. It should have been calibrated before hand, and after its previous use. Also the accuracy of the speedometer. Sounds like a hard ticket to challenge though, good luck.

Check the laws, some states don't allow a Police officer to use their radar while they are driving unless they have two officers in the car and the officer using the radar is in the passenger seat. I know that is how it is in PA where i live. If he was by himself, check the law book.
