Post I, too, just got a ticket for my exhaust...'Excessive Noise'

And yes, I will be contesting it. The officer was very honest, however, and didn't know anything about that noise limit...I'm calling the court tomorrow to find out if there is one in NJ...Man I'm ticked...The cop said that it was probably just a $44 fine...Which is $44 too much for me!

Edit: I have a Stromung...It isn't /that/ loud...::grumble::

NJ likes silence apparently... do they still have that neanderthal law in Jersey City,NJ that bans woofers larger than 8" in diameter in cars?

OK this may be really old (shows my age) as I first heard about it over 10 years ago.

This is rediculous... The officer didn't even know what the law was, yet he gave you a ticket? Did he use a Db meter? Hmmm, sounds loud, so it MUST be illegal? Total BS! This should be a no-brainer contest! Good luck and let us know how it turns out.

hey, at least you guys don't have a law that says the exhaust cannot be modified or replaced in ANY way that makes it louder than stock

Ok, I made a few calls and searched around on the internet and here's what I can find, which mostly applies to NJ.

Since most laws simply state that 'excessive' noise is cause for a summons, it is fairly hard to enforce and actually get to stick in court. It is very judgemental and subjective.

NJ has /NO/ regulations that I can find (nor can the NJ legistlature office find) that explain how much is too much (excessive), nor can they actually find any real precedences (maybe one, but I can't seem to find it). There is no law, statute, regulation, or otherwise, that says how much is too much.

The NJ Statute that my ticket falls under is 39:3-70. My exhaust (Stromung) is no louder than a school bus (not kidding, really...Maybe only slightly louder). I understand that diesel fuel engines have slightly different standards, but still. If a school bus can make that noise, but I cannot, then I'm sorry but it's wrong. The road I was on was a road frequently traveled by school buses (schools all around). It was a residential area, but I do not believe I was creating excessive noise with my exhaust. Nor was I disturbing the peace or anything. The officer was sitting on the side of the road, and as I drove by (going the speed limit, mind you, and not revving particularly high), he pulled out behind me and followed me for a short while (presumably while he called my plate in). I knew he was going to pull me over as soon as he pulled out behind me. He put on his lights and I promptly pulled over and was very cooperative, and called him 'Sir'. It was his OPINION that neither he or anyone else should have to hear my exhaust. He said very clearly that he doesn't believe that anyone should have to listen to it. Personally, I don't think opinions should be used to enforce laws or statutes. I'm calling the court tomorrow morning to find out what I can do about it. If worse comes to worse, I will pay the fine because I have to, but I won't like it. Eventually, I could be forced to take my exhaust off because I work in the area where the cop is. He will continually see me drive by, and I believe that he may pull me over again and again. You know what's funny? I was at the police station two or three weeks ago, with tons of cops around, and none of them said ANYTHING! Remember the Cape May meet? A whole bunch of loud Subaru's, nope, they didn't say anything about our exhausts (even though we got stopped, by not only a police officer but a park ranger type guy).

I'll gladly let you know how all this goes. Wish me luck.

I got pulled over by a cop who said my brights were on even though they wern't it was just my fog lights. I figured out how to get away with using my fog lights since there is no local law prohibiting foglights I can always use them since its a svx and there right next to the regular lights if I get pulled over again I'll prove to the cop the brights wern't on and what they would look like if they there on

If you have any interest in making it a little quieter you can have a 18" glasspack or resonator installed in your intermediate pipe (if you have the non-resonated Stromung pipe). I had a 12" glasspack installed in mine (I don't really know the difference, actually, between a glasspack and a resonator).

I liked the sound too (actually I have a Scoobysport with the Stromung i-pipe) and didn't want to lose performance - but I was getting a little too anxious driving by police. I don't think I really lost any performance. The 12" glasspack really doesn't quiet it down much. The 18" is probably noticeably more effective. Not much will change at WOT.

Well for the noise law is there a certain db level that they specify? If so find out what it is and then find out the db comming from the stromug. If you can come in with proof like that you'll get off the hook for sure.

As I said, there is no regulation that I can find in NJ...Just the statute warning about 'excessive noise'...We'll see tomorrow when I call the court...

So how exactly is it that those Harley motorbikers get away with making SOOOO much noise? I swear, one nearly blew out my eardrums from over 50metres away... I was literally in pain.

I concur with you, there are indeed different standards of judging "excessive noise" between classes of vehicles.

what???? $44? that's too much! CA is around $10 or $20. Get the exhaust noise tested at a highway patrol or somewhere.

Well, as I said before my major worry is being stopped again and again, especially by the same officer...RSes don't exactly blend into the rest of the crowd, and I'm sure he'll remember it. If he sees me drive by again, what's to stop him from pulling me over yet again and issuing me another summons for the same thing.

If I thought that my exhaust was actually making 'excessive noise', I would gladly pay the fine and get it over with. However, I firmly believe that the officer was in error, and that I am not in violation of the statute. I'm still a bit miffed about it...The cop was waiting along the side of the road for awhile (I had passed him going to my office), then nearly 30 minutes later when I passed him going the other direction he followed me, then pulled me over. IMHO he was looking for someone to give a ticket to (sitting along the side of the road on a residential street), and I guess I just fit the bill.

Fido,

What is the statute # or the number of the violation on the ticket? Was it this one:

39:3-70. Mufflers
Every motor vehicle having a combustion motor shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and annoying smoke, and no person shall use a muffler cut-out, bypass or similar device upon a motor vehicle on a highway.


I couldn't find anything else.

If you guys are so pissed about crap laws like this, next election cycle call up the local candidates that are running for city council/state legislature and ask them about their position on this issue (and others that you care about) and base your vote on that!

There is nothing like concerned voters to get laws changes (unless it's rich and powerful lobbyists)

Yeah Kevin, that's the one...As you can tell it only states that the muffler should be in goood working order, and prevent excessive noise. I don't think for one minute that my stromung creates excessive noise, and it's surely in good working order Nowhere does it actually say what is to be considered 'excessive'...I even called the NJ office of Legislature and asked them...

Well does the same law apply for the afore-mentioned Harley's? I can GUARANTEE that their STOCK muffler is louder than a Stromung. Probably even louder than a 3" straight pipe... Basically is comes down to the officer's personal discretion. (Hate laws like that) You could fight it though, as they have not defined a standard for "excessive". I would just get a resonated mid-pipe. You wouldn't lose any noticable power.
