Joel,
I was submitting a query for a 95 Audi S6 at Imotors.com and it came up to be $0. Knowing Imotors.com has been very reputable and they don't want to mess anything up before their IPO, I sent in my fully refundable $250 deposit. I got confirmation of the price of $0 including tax, license, and other fees. Now we all know this is a mistake, but do I have any legal cases to have them give me the car for $0? They haven't contacted me yet.

I seriously doubt it. You would if you'd already paid for it (direct bank transfer or credit card). The second an actual person gets involved it probably won't fly, but if you'd already paid for it you might have a chance.

Hello,
The law isn't so blind, folks. Almost anytime one party is aware of a mistake of the other party, the innocent party wins out. So here, you are aware (good luck arguing that you thought the car was really for sale for $0) of their mistake so you can't take advantage of it. In law, we say that a contract requires a "meeting of the minds." When your mind is thinking "they don't know it's free" and they're thinking "it's $35k" then y'all aren't having that meeting of the minds So no contract exists.Joel Edit: of course, none of this is legal advice and don't even think of trying to hold it against me. Well maybe if I'm lucky I might have a chance to slip through the cracks.
Joel...that seem's correct. The e-mail has no terms and conditions attached hereto, and no legal document has been issued nor signed regarding title. Maybe if it was quoted at $12,000, I would have a chance to get it for that price. |
