Default Ok, so I need to hire some thugs for dirty work!

Argh! So here is my bad story.

I got promoted into my current position 4 months ago when they other guy has his employment ceased (he is now currently unemployed from two other jobs in the time span...gotta love coke fiends...but now I am getting off topic).

So here is why I am so upset.
He used to do the department pay, a task that is now my job.

Well, I have been going through and audited the old pay and profit/loss statements to show the improvement in profits since I took over, and found out he had been ripping me off for the past 20 months till I got his job.



Found out that he lied to me and straight ot my face even more than I thought, and basically pilfered $700-800/month of my pay into his own. Had no intention of ever telling me about it, or revealing it, etc.

Originally I thought it was 'only' $300 or so a month, but revelations tonight showed it was a lot more.

On top of this, in this Audit, I have also shown that he was rupping off the owner too, who is not too pleased with everything now. (gotta support the coke habbits one way or another I guess!)

So rough estimates after auditing the last 12 months puts it around $7500 he stole form me and put in his own pocket. Cant wait to do the next 10 months and see what it is!

Why, Why, Why are there people like this in the world! I mean, yeah, there are reasons he is no longer working here, but this was NOT a good way to start out the day.

My goal was to show how much profits have increased to back up my petition for a pay increase, and I ended up finding out how much money I was screwed out of! ARGH!
(NO fault of the owner of the store of course, and nothing they can do to help really, but it is aggravating!!!!)


So does anyone hire out their muscle???

(PS: Of course I know violence is not the answer, just very upset about it. Cant think of what to do either. Small claims court was suggested against the former employee, but I dont see that going anywhere.)

Barry,

If you were screwed out of pay, the owner is responsible. Whether or not you want to tell him this is another issue all together. Good luck.

I found out I got screwed out of pay a few years ago but my company would never do that intentionally, one of the employees just wasn't doing his job correctly. I requested an audit of all of my files and got about $5k back (turns out I was overpaid on one deal also). Maybe your boss will pay you what you are owed? It is the right thing to do. Good luck!

Well, It was definitely not his fault, just this one employee. So It is tough. And also, added into the mix, it is not that I just did not get paid, but that he got the money. I talked to my boss (the owner) about it, and basically, he said there is not much he can do (and I cannot push the subject too much in my opinion, with him).
It is not just lost money no one got paid, it was paid out to this Jerk...thats the problem. Even though he does feel bad, he did already pay the money out once.

Well that's what I meant. Technically he owes you the money, but politically not a good idea to chase it. Call the cops. Sue him (the guy who stole, not your boss) for restitution.

What this person did is called "embezzlement" and depending on the circumstances may be a federal crime. He certainly is eligible for some deluxe accomodations courtesy of your state government. I'm sure you could call your Attorney General's office and tip them off with little risk to yourself.

Small claims court is only for claims of $3,000 or so (not sure about MA), getting the judgement from the court is the easy part, collecting it is another. You can file small claims on your own - no lawyer needed. Does the guy own a house? Then you could attach the house so that you'd get paid when he sold it.

Talk to a lawyer if the amount is significantly larger, it may be worth pursuing, especially if the attorney is willing to work on contingency of collecting.

Get all your documents lined up and go to the cops. This guy should be in jail. F him. Let him sell his car/house/dog to pay you and the company back, then let him beg for a plea deal for "doing the right thing."

He is pursuing what he can, but it is also a cost/benefit on what his legal fees will be as opposed to what he woudl gain to earn back, if he was able to collect.

well, not exactly that I did not know about it and not notice it missing.
There were different elevator and performance bonuses, base don the departments performanc,e not individual. He said we did not make them, I believe him. Now I found out we did meet them, and he added my bonuses into his own. So It was not that I was missing Money as I was told I would not be getting it. The problem was he lied about getting it and kept it.

I only hire out one muscle... and that is only to pretty young ladies!

That does suck man... I had a former employer rip me off of a whole week's pay check, but it was an under the table type job. Not as serious as your situation but it still sucks to have people steal money you earned!

Take it to the local DA and have them prosecute on the criminal case. Once he is found guilty for that, the civil case should be a slam dunk and cost very little. The owner should do it on principal alone and to make an example out of him.

I bet unemployment would like to know the circustances as well, since he should not be able to collect.

Once he is in jail, you will not need to wish violence upon him, that will happen for free.

i'd say, before muscle is hired, talk to you're boss, and whoever else got scammed by this guy , and all of you go after him in some sort of civil suit after a criminal trial, as tuned said...get everyone that was ever screwed by this guy to come together and make his life owrse than it will be.

here is what i charge, what do you want?

shot at repeatedly by paintball gun - $25 (plus ammo)
vandalism of his property: car and/or house - $100 (plus paint)
abducting his wife and/or significant other - $500 + getaway car (wrx wagon preferred)
arson of private property - please call for details (special only for this weekend)

i also consider all custom jobs, please do not be afraid to ask. i meet most requests. also a 25% discount on next job if not completely satisfied.

just kidding, i aint in to violence. but this ****** will get whats coming to him one day. its karma.

Also......

Was it just you and the boss who he was ripping off? Or was it every commissioned and bonus incentivized person in the company. Could be huge money....not just petty $1k/month stuff. Might even have $$ stashed away. Maybe you'll get some back. I know of a nice 64 1/2 red on red Mustang for sale

He will get whats coming. Lynch party or not. It all comes around.

Paper cuts (legal document trail) hurt longer and harder than any ol' fashion beat down. IRS, local authorities, courts, and unemployment will have a record should this be brought to court and he will feel the sting.

Garnish the wages, not qualifying for unemployment, paying fines, making restitution.....it all sounds better than not getting anything cause he's in a hospital bed and can't do anything TO pay you back.

yah, I am not actually going to resort to violence...it was just very aggravating to find out.
