This all boils down to the same thing as the people that get a speeding ticket for doing eleventy thousand miles over the limit and want to fight it.

Yeah they might have made a mistake by saying it had it, but since it was important to you, you shoulda double checked...

You made the mistake and are now looking for places to point your finger for YOUR mistake.

Just like the guys that get a ticket for speeding or the ones that blow up their motor and trying to blame someone else, It is their fault, as was the purchase without exercising your right to pre-inspection is yours.

I don't mean to kick you when you are down, or throw salt on your wound, im sorry if it looks that way. Seriously, man up to it! You made a mistake now MOVE ON.

Are you smoking crack, or were you born that way? The dealer misrepresented what he sold to him. That's illegal, end of story. Knowing what an optional ABS pump looks like and where it maybe located under the plastic panels covering an engine bay is not a prerequisite for buying a car and not getting ripped off.

it wouldn't be that expensive for you to have a lawyer draw up a letter. if the few hundred bucks is too much, it's not that important and you might as well drop it.

you analogy is extremely poor. it's not a situation where he just assumed it had ABS w/out asking. in that case, it would have been his fault.

instead, he was repeatedly assured that it did. the dealer knew or should have known that it didn't. that's misrepresentation. whether it's material or not is another matter, but it certainly isn't his mistake.

what if the odometer had been rolled back? would that have been "his mistake" as well? should he have to disassemble the engine to check its condition? he had a right to rely on the dealer's statements...it was fully reasonable for him to do so.

I have a question though... Why cant that stealership find you a mazda 6 w/ abs?

What I would do in your shoes, is to print out the website (where it says 7 day return policy), or take a picture of the monitor with a camera (so they cant say that you changed the text). Then go to the stealership, and demand they take it back.

If they dont, could he get the police get involved? OR would he HAVE to get a lawyer?

Have you even seen a movie where the used car saleman was not totally sleazy?

If you need to buy used, buy from a 60-year old private party who lives in Newport Beach or Beverly Hills.

well that exactly what happened he never verified it on his own or double checked the dealers word... like I said in above post would you buy something that was claimed to be inspected without reading the inspection first (ie house)?

Whose to say the dealership was just repeating something they were told is true (from previous owner or faulty inspection). I am not saying that they SHOULD have known but that is not a legal arguement. Legally the definition of fraud is KNOWINGLY misleading a customer on facts behind a sale. Who's to say the salesperson wasn't just reading of a faulty car fax??

There is lack of self responsiblity here and that is the same as suing mcdonalds for not telling you that their food makes you fat. ie common sense: look before you buy!

No he is neither he sells cars and knows the LEGAL rights he has and how is protected under the law.

IE look up fraud in the dictionary...

If he didn't know what ABS looked like why didn't he ask about it. I know many people that look AT THE ENGINE BAY before buying a car, why didn't he ask what was there??
