CHP. Freaking out.. am I fuxored???

Quick skinny, I was arrested for wreckless driving a few months ago. Spare the lectures about driver saftey, I drive slower than most grannies.

The officer was really flagrent.. arrested me, impounded my car, wrote up the nastiest report i've ever heard of. After consulting my attorney, she found out he has a history of flagrent arrests.. even arrested some guy for driving 70 mph for a wreckless, and detained his two 3 year olds in the car while he sat in jail (nice).

Anyhow to cut to the chase, today was my court date and I can't tell if we got hammered or not. Everyone kept telling me how lucky I was with the slap on the wrist I received.. but I really am freaked out. The judge reduced the fine down to $33 (yah), sentanced me to one day in jail (time served for the day i sat in jail when arrested), and dropped the misdermeanor. Instead he reduced it to infractions, THREE of them.

Speeding over 100mph (2 pts)
Tailgating
Unsafe lane changes

Now last I checked, that totals 4 points.. I have 0 points on my record, am I just hosed? My attorney mentioned something about there being a maximum point per citation but I haven't found anything on the subject- can't tell if she's just trying to lesson the blow to me.

Does anyone know?

Technically he was in the right for arresting you for reckless driving.

You probably have 4 now, which will be expensive on the insurance.

Yeah totally.. i'm not contesting that at all. To be completely honest it probably did me a great service in terms of reality checks. Off-track go fast lifestyle no more.

The thing i'm really worried about is that from what i understand 4pts = automatic dmv suspension...

You might want to ask the judge if you can do community service to get rid of one of the points on your license. Sometimes they will allow you to do this. Just know that it will be a lot of community service.

It doesn't sound like your lawyer did there part too well.

4 points in one year puts you right on the edge of suspension... ask me how I know. But, if you avoid any further tickets, you'll keep your license.

i think u need 6 points to have your license revoked. so you are still good for 2 more 1 point infractions!

k, thanks a lot guys for the feedback.. i'm going to trek down to the DMV in a week and see exactly how many points got recorded! Helllllo freaky high insurance rates!

Any of you have any experience with removing points from your record? Found a site for 'stan the radar man' that seems to talk about point removal. If you talk to him say Chad sent you.. maybe he will give me a break when I try to have him remove the bucket load of points i've acrewed. :-)

On one ticket you can only get the amount of point for the largest infraction. The way it was explained to me was if you had a "speed contest" "wreckless driving" and another misdemeanor, than you can only get the points for the entire thing being on one ticket. Case in point, if you got all those, you'd only get 2 points since it was all at the same time.

Rich, glad you mentioned that- you literally quoted my attorney word for word... I just wish I could find that documented someplace in DMV literature. I sure hope thats correct. Thanks

O.T. I got a speeding ticket 3 months ago, but nothing has shown up yet, no "courtesy notice" or anything (i even called the courthouse). Is this the normal processing time??
