Default Traffic School

How does it work?

I have 2 points (2 speeding ticks) and I haven't gone to traffic school in the past 5 years (ever). How can I get one of those points off my record? Did I need to go to court for that? Can I just complete the course and take the proof to DMV or something?

Thanks,

Alex

What's up Alex? It's been awhile.

I believe you get a choice when it's time to pay the fine (if you're eligible). Sounds like you are, because I think you can go if you haven't been to Traffic School in the last 18 months.

Or you can possibly try to fight it

Sometimes it works, did for me

Yeah, that's about right.

I've heard two versions of the story:

1 - You can take traffic school once every 18 months, and remove one point every time.

2 - IF you get another ticket within 18 months after taking traffic school, the point you removed gets RE-ADDED to your record, thus leaving you with at least 2 points...

It would be a good idea to find out which is true before taking traffic school.

So, all that boost got to ya eh Alex?

Hmm, well, I don't think the points get re-added on if you get a 2nd ticket within 18 months. You just can't clear/hide that second point with traffic school, and the other one you got earlier stays hidden. Anyway, if you want a "good" traffic school, go to the Oakland Chinatown one.

yeah, i went to the Oakland Chinatown one, it was good! for one thing, they spent a whole lot of time clearing up the points/traffic school issue, and they let us out a few hrs early! so didn't have to sit there for the entire day!

from what i remember, if this second point is for the new ticket, then traffic school would make that point stay off your record. but within the next 18 months, if you get another ticket, then those points get added up. you get 4 points for the first year starting from your first ticket, if all 4 are used within that year, then yr license is suspended. after one year of the first ticket, you get 2 more points. i forgot about the third year. but hopefully that's enough tickets already!!

i'm reading through this, and i hope it's making sense to ya!

You need to appear in court and request traffic school, you cant, unfortunately , just go and show proof at a later hearing. As far as I know, the points removed are exactly that, expunged forever, irregardless of future offenses. I will check with my pop's, he's an attorney, though I am relatively sure of these ~facts...

oh, last time i went to traffic school, i only needed to call the court and they had an automated service for me to choose whether i would pay or go to traffic school. (good thing they had that, court was in sac! guess it depends on the county tho)

and yeah, once the points are gone, they're gone forever, won't ever come back.

So if the court date passed and I have 2 point on my record, can I remove them anyhow?

Ah...the glory of having points on your record. This is something I know quite a bit about.

Most everyone is correct - once you go to traffic school to have a point removed, it's gone forever. However, the ticket still remains on your record, you just don't get a point for insurance purposes. The typical traffic violation will drop off of your record after 3 years.

You MUST choose traffic school at the time you pay the fine. At that time, you must also pay the wonderful court system an extra fee for choosing traffic school. This varies from county to county, but typically it's around $30. That's on top of the fine you must already pay for admitting guilt. If you have already paid your fines and did not opt to take traffic school, it's too late.

You cannot choose traffic school for any violations/misdemeanors with 2 or more points allocated to them (speeds over 100, more than 20 over speed-limit, speed contest[racing]).

As a side note, sometimes just showing up in court and admitting guilt, your fine may be reduced. This depends on the judge, of course, but I went for my last ticket up here in Roseville and my fine was reduced from $189 to $91. Big difference!!

edit - Forgot to mention that you are eligible for traffic school after 18 months from the citation date.

Hope this helps some....

You can also do traffic school on the web. Basically you sign up and pay the $35.00 fee and you have about 1-2 months to complete the school (basically what time the court will give you). I did this about 2 years ago and it worked great. You log on the internet school you want, get an account with them, and take the course from your computer.

As for when you can take traffic school, it is every 18-months between citations. So if you get a ticket today, you can go to traffic school and get it removed, but you cannot go to traffic school again (to remove another point) for another 18-months. After that 18-month period, if you get a ticket, then you can go to school again.

Cheers

EddyL.

One warning about internet-based traffic schools: not all courts allow them. But if the court does, they can be great.

Also, the 18 months (and 3 years before most citations totally drop off your record) is based on the citation date, NOT the conviction date.

You cannot use traffic school to remove a 2 point offense - ie: reckless driving, DUI, hit and run, etc. These will ALSO stay on your record for 7, not 3 years. Sorry, but there is no excuse for any of those.

At fault accidents are normally 1 point. You may ALSO be convicted of a driving offense in relation to the accident, giving you another 1 or 2 points.

There is a maximum of 4 points in the previous year, 6 in the previous 2 years or 8 in the previous three years.

*** Warning: everything below here is my understanding of the law, and not garunteed to be accurate. ***

As for the ticket... I *think* if you go to traffic school, not only is it expunged for insurance reasons, it is expunged as far as points towards losing your license goes, but it's still there for viewing as a citation. (IE: You WERE given a citation, but were let out of the long-term penalties)

I've never heard of it being re-added before. Doesn't make much sense, really, as most insurance companies consider 1 point still to be a good driver, so it doesn't hurt having it there. Thus, why bother removing it, if it doesn't hurt, and if you get a second ticket, it'll reappear?

Also, if you go to court, you may always ask that you be allowed to go to traffic school - even if you have gone in the last 18 months, but ... the way I read it, even if you go more than once, only one point will be expunged at a time - so the second time just costs you more (unless, you can get the judge to waive all fines in exchange for traffic school)

Of course, it's always best to try not to break the law, but noone is perfect. That includes the officer who cited you.

No one really answered my question yet.

I have 2 tickets. 1 point each. I didn't go to the court. Say, it was 3 months ago. Can I do anything about it now? I want to go the traffic school NOW and get 1 point off my record.

Can I do it?

it depends if you have already paid the fines yet. if you have, then it's too late to go to traffic school. (at least that's my understanding)

Ok listen to me Ive been there, messed up everything once.
You got these tickets however long ago...you didn't apear in court...however long ago...you need to go down and apear...the judge will allow you to go to traffic school for only one of the ticket...because you can only go to traffic school once for every ticket within 18 mos of one another...you will still end up with one point...look on the bright side, at least you have your coilovers and I dont after waiting 4 months 6 days and counting.

Okay, Alex. I've gotten two tickets w/in a month of eachother. Both should have a court date on it. You can choose to go to court and argue the case and if you lose, you can pay the fine at which time they will offer you the option of Traffic school. If you do not accept it, you keep your point on your record. You can only remove 1 point off your record. The other point will remain on your record for 3 years. If available, always go to traffic school. Most counties accept on-line service and it take literally 30-60 minutes to complete. If you waived your right to attend traffic school, there is no way to remove it later. You'll have to wait 3 years to remove from your records. I would consult a lawyer if you missed your dates.

If you fight a ticket in Ca, you cannot go to traffic school. You also have to pay first before you can fight it.

Nothing, it just goes on to your record anyway.
