Unhappy Have you disputed a fix-it ticket? Help me!

This is a Re-post from NASIOC General:

Ah... where do I begin. I was driving my friend to a towing yard because his car was towed, but we got lost. While driving down this road, 2 R32s blow past me and get infront of me only to stop at a light. (his friend being on his right at a 2 left lane signal) Well, A cop pulls up behind me and waits for the light. When it turned green, the cop hits his lights. The R32 keeps going and I get pulled over.

My car is pretty much stock minus a cat-back exhaust. I have a 2005 STI with an HKS Carbon-Titanium Cat-back. Well, conitnuing with the story.

The cop walks up to me and does the license and registration stuff and as I was giving him my ID, Proof, and Reg, he starts going off about "So you boys racing down MY Street?" ****. Honestly, I didn't even get the chance to. Well, he starts Running my ID along with my 2 passengers. When he gets back, he gives me a ticket for a "loud exhaust" and starting going on and on about "Don't think I don't know what you guys were doing down MY street. I know it was Coincidence." God I hate being in the wrong place at the wrong time.

This may sound Noobie, but I seriously have never gotten a ticket before. Any way I can get out of this?

(btw, i'm checking to see if it's CARB legal... but I dont know if that'll even help considering the ticket is for a "Loud Exhaust")

Has anyone else had to deal with this.

*Edit it's a CVC 27150(a) and yes is checked for Correctable Violation

just swap out the exhaust and pay it man... any exhaust tip that can fit a 2 liter bottle is bound to get attention like that. It's your freedom to put it back or not afterwards... it's just a lot of hassle to go through and that's about it

i got one but mine was not correctible. same situation but I was with my other Subaru friends. the cops said we were racing, which we were not, we were tired from racing the day before and he gave me an exhaust ticket and a intake ticket. to make a long story short I am going to court 4 months later after visiting the state ref 3 times and am going to fight it. I have carb stickers on both pieces of equipment. pay the fix it. I wish that was all I got.

p.s. stay away from Fullerton P.D.

I attempted to fight a fix-it for my exhaust just to see if it was possible. My defense was the officer did not have proper equipment nor did he attempt to listen to my exhaust in a more controlled environment. I lost. Paid the bail, $170.

Your problem was that you didnt know what 'proper equipment' he needed to conclude that your exhaust noise exceeded 95dBs. I wouldve fought that........throw in some technicalities .

This is what you should do: Invest in the HKS 120mm silencer for your exhaust, and then go to the state referee to get it DB checked, it will pass easily with only exhaust, downpipe could be a different matter. It'll cost somewhere like $10-20 for the ticket, and the silencer is $35. Way better than paying 100+ and you can do it every single time, and even have evidence that it does pass.

BTW being CARB legal has nothing to do with a loud exhaust and vice versa. Flashing a cop the carb stickers won't prevent him from giving you a loud exhaust ticket, and most of the time they'll just ignore any of your documentation anyway. Just follow what I said above and you'll be paying 1/10th the amount every time you get another exhaust ticket.

I would've done the same for mine but broke my collar bone during the time I had to go down, and I was too busy to have it done Oh well I'm sure there'll be another time

It's stated that the officer has good enough judgement to know whether or not an exhaust is louder than the 95dba limit, so a DB meter does not have to be used in order to be issued a ticket.

The same way CHP can determine speeding visually without pacing or radar. What ever happened to guilty beyond a reasonable doubt eh?

Cat-back exhausts don't need to be CARB-legal. Just setup an appointment with a smog ref to get your "loud" exhaust sound-level checked. You'll get 3 passes. The test official will use a device to setup the sound-level meter 20" away from your tail pipe and at a 45-degree angle from your outlet. The legal limit is 95dB. As long as your test results are below that (actually, they'll even pass you if you are at 96dB, due to tolerance for measurement error), the officially can print you up a certificate free of charge. You can show the judge this certificate and get the ticket dismissed (pay only $10 court fee). You can also keep the certificate on hand in the event you get pulled over for loud exhaust again (show it to a cop and they "should" let it go from there).

I'll search for the phone number you can call later so my session here doesn't time out on me.

EDIT: (800) 622-7733 . That's the number to call if you want to get your exhaust sound level checked by a smog ref. They will test you free of charge and will even give you a free certificate if you pass. Call to setup an appointment. There really isn't much excuse for not seeing just how loud your aftermarket setup is.

I'd pay particular attention to section 27150.5 and 27150.7 of the Vehicle Code. (.5 requires retail exhaust sellers/installers to install only exhaust systems compliant with the 95dB limit....27150.7 says you can get it dismissed with either a certificate as I described in my other post or if you had reasonable grounds to believe your exhaust was in good working order AND you believe it was under 95dB already.

kpxplaya and InsaneZane got it right.

I got a modified exhaust ticket on my last car (integra) and went to the ref to get it checked. Apexi N1 with no silencer passed. Went to court, paid nothing.
