Default Missing part of my tire. Is it ok?

I'm running 16 in Pzero Nero M+S on my 2.5i Legacy wagon. While rotating my tires this evening, I noticed that I was missing a chunk of my tire. The missing piece is pretty deep, but it's not down to the cord. Can this type of damage be covered under the tire's warranty? I have about 12k miles on the tires.

I'm guessing that the tire is ok, but I wanted to see what the gurus thought?

...get a new one if possible....but if it isn't down to the cords....ya likley gonna be ok on it.
