Default Towing damage help (not towed on 2 wheels issue)

My towing damage acctually doesnt involve being towed without a flatbed truck. When i had my car towed it was put on the back of a flat bed and strapped down. As the tow truck was following me out of the parking lot the car came loose in the back and the car rolled forward and hit a bar damaging the hood, light, front apron and grill. The company owns a repair shop and obviously wanted me to take it there, but i got a quote from another repair shop and told them i would fix it there. So they offered to fix it at their place a long with other things trying to intice me. They want to pay for it without informing their inurance company by paying a repair shop directly and obviously giving me trouble about the price. After i informed them that i will be having it fixed at another body shop they said they would have to look at the damage and then make a decision. My question is can i just tell them i want a check for the damage and get it fixed on my own. I am sure they are going to quote me less for the damage and then refuse to pay and say they can fix it cheaper. Should I even let them look at the car if it has nothing to do with their insurance company? I really dont want to go to court to get this settled. They told me they dont want to pay that much money to fix a 7 year old car. Any ideas on what i could do as I have no experience in this?

if you want you can take it to court...it doesnt matter if they can fix it for cheaper, you get to decide where you want it fixed...get a few more quotes from other places that are around the same price as the first quote you got and they will have to pay up.

I'd take it up directly with their insurance carrier. I think they have to tell you, especially if you file a police report. If they won't budge, you can get their license number and call TXDoT to find the carrier.

They said that they are not going to tell their insurance company and want to pay for it out of pocket. Do they have to tell their insurance company about the accident? That is why they are giving me trouble and trying to get the lowest price then pay out of pocket. It's the original reason they want me to take it to their own body shop. I got the name of their insurance company after asking them multiple times.

Do not take a check frmo them. Do not let them do the work themselves.

You MUST file with their insurance company... if there is more damage than estimated, the shop is not going to ggive you anymore money... if you file it on their insurance, their insurance will pay the supplimentals the shop you choose gives them.

It is Texas state law that you are allowed to take the car to any shop you so desire and cannot be told where to take it.

I hate to put it this way, but if you do not file on their insurance, you will be the fool in the end.

I guess I will be calling their insurance company and informing them of the accident then. The car was towed through AAA so maybe they can help me out. The only thing I dont understand is since they have not informed their insurance company of the accident and want to pay for it out of pocket, I will be the first to talk with their insurance company and then their insurance company will contact them. They keep telling me they dont have to contact their insurance but does the law say they have to file a claim or can i file the claim with their insurance? Now that i type it i guess i can just file the claim with their insurance huh. This damage while in tow thing is just throwing me off.

he way it goes with any insurance claim... if your car is damamged, you file... no one else files for you. If you got into a wreck, you would call the other person's insurance to file a claim... you don't wait for them. Their insurance will contact them and that will be that.

Ok, thanks for the help. I think since the damage was from a company and not an individual it was confusing me. This is 2 months old now since the first claim got " lost " in the mail and they couldnt find it. I just recently found out they were not going through their insurance company and were trying to pay for it out of pocket. When i asked them what other options i had beside letting them fix it they would only say the law states they get a chance to fix it. It also states they have to tell me my option of getting it fixed where i want to i believe. Now the fighting with their insurance company begins I guess. On my last question, should i even let the towing company come and look at the damage themselves. They already took pictures the day of the accident. Is there any reason I should let them come and look at it again since it has nothing to do with real insurance?

Don't waste your time with the towing company. Their insurance company will be the ONLY people you deal with from here on out.

And they are wrong with them getting a chance to fix it... they would not be working in your best interest... the are a towing company, not a collision repair company... if the car is damamged in the collision repair shop, they get to fix it, not if it is damaged on the tow truck.

They are towing company and a repair shop I believe. Maybe they were going to claim it on insurance and use the money to pay themselves to fix the damage they caused. They are not going to be happy tomorrow when they found out I called the insurance company. They acctually pulled the guy out of a meeting when i asked what the claim number for the insurance company was for this accident.

They were not going to claim anytyhing... they were ging to do a half assed repair job that will fall apart on you down the road and not tell their insurance company. Just like auto insurance, claims make them pay more... they don't want that....
