Default Dumbass ESL Lexus driver sideswipes me, then (I believe) tries to run...

CN: title pretty much says it all.

Here's where it happened, pretty much smack in the center of the map.



I left work (it's off the map's top edge by 1 mile) tonight, crossed Rt 1, and picked up the 9 as a shortcut to 440/287 (Rt 1 is a total nightmare any more). Where I make the transition the road is 3 lanes wide; the left 2 go toward the bridge, the right is the exit before the bridge for 440/287.

I was driving along in the right lane, about to put on my signal to angle into the departure curve, when a Lexus RX330 came ripping up the middle lane and swerved right into my car, their passenger side on my driver's side, and forced me completely off the road.

I hit the brakes because a) the condition of the road shoulder is crap and b) to make sure there was no serious damage. The driver of the Lexus simply continued along the highway and entered the departure curve, not even making the appearance of slowing down or pulling over.

I got back into traffic while dialling 911 to report a potential hit & run. The Lexus drove through the departure curve, went PAST the exit for Industrial Ave, and got onto the 440. I kept up right behind, jotting the plate # and exact make/model (even that it wasn't the stupid "h" model). The Lexus continued along the highway.

At one point, shortly before the 514 exit (just off the map's left edge) they started to slow down and pull onto the shoulder, so I started doing the same; it was an OK place to pull over, big wide shoulder/breakdown lane etc. But then they just got back onto the highway and drove away, so I continued following. Finally they exited onto 514 east, and eventually pulled over in a parking lot right where the "Valentine" is on the map.

I jumped out of the car with insurance etc. info in hand and walked straight over to the other car; I didn't even stop to closely inspect my car because I was very suspicious of the Lexus trying to take off again; until the officer showed up I never strayed more than 10' from the vehicle.

The Lexus had 2 people in it; the driver was perm'd-out and spoke nearly no English, with a serious Russian accent. She just said "I don't know what happened." I didn't reply to that (I didn't want to say anything beyond the absolute necessities until a po-po arrived) altho in my mind I was screaming "you're GODDAMN RIGHT you have don't know what happened because YOU WEREN'T PAYING ANY ****ING ATTENTION!!!" The passenger, obviously the daughter, did what translating was necessary and copied out my insurance info, but didn't produce any for me, even though I asked twice.

Eventually a NJ Statey showed up (because it was a potential H&R), at which point the other driver magically produced insurance info. He was clearly somewhat displeased that there was really no H&R, but I wasn't going to not-call the report, and run the risk that the Russkies would try to say that they stopped and I didn't. He spoke with each party briefly, verified nobody was hurt, copied all the info, and went on his way. It wasn't until after he'd left that I looked at the info he'd copied and saw that the other driver's insurance card expired a week ago. I shoulda demanded that he open a report while he was there. Now I'm torn between re-visiting this with the authorities tomorrow ("hey, I was in an accident last night with a driver whose insurance turns out to be expired") or wait & see what happens.

The damage is bad enough that it'll require serious TLC, possibly sheetmetal replacement, to be made right. The driver's door is scarred right at the rear edge, and a sizeable scratch-band runs back along the passenger door (right where the sheetmetal makes the complex curve to the top edge of the skin), the complex curve of that doorskin is spoiled, and the rear fender in front of the wheel arch is scarred. So I'm looking at at least a repaint of 1/4 of the car; hopefully AllState doesn't try to foist a blend for anything.

The worst part of this is, at the start of 2006 I earned All State's best "treatment" level, after 5 years event-free coverage with them. That's gone and, even though this whole event was somebody else's doing, it's going to cost me extra every month for years. I just finished calling to start the claim, and I can't even get the appraiser's estimate (to find out just how badly I'll be getting $-jacked in the long run) until next Tuesday.

Sorry? The only thing I wanted to offer her was a bruise in the shape of the ring on my right hand, but I made a point to have as little contact with them as possible until the trooper arrived. I talked across the parking lot to a few few diner patrons who came around and asked if we were all right, rather than talk to the two who hit me.

I shoulda, but an officer on the way (he called twice to give his ETA, because he didn't know that it wasn't really a H&R) and an entire diner full of people staring out at us is a recipe for much more serious, and long-lived, trouble. I work for a regulated financial firm and hold an investment license, and even a hint of trouble with the authorities would mean the end of that career pretty quickly. Kinda sucks that, the more one wants to achieve and the harder one is willing to work to achieve it, the less free one is to kick the crap out of somebody who has already demonstrated they are not fit for public appearances.

Life should come with little "easter eggs" like in Contra or something. Like, "Congratulations! You've lived a good and honest life for XX days! You may go punch one person 3 times, or 3 people one time each, without fear of repercussions. X=continue O=choose your targets."

I'm still not sure why your insurance would go up for a not at fault accident with a potentially uninsured driver who's contact info you have? As I understand, it is illegal for insurance to punish you for making claims on events that were not your fault, they are only able to raise your rates if you are at fault, or at least according to NJ, you didn't graduate college.

Insurance carriers rate each driver into one category, from "has 10 points and an accident every week" to "never-ever had an accident or violation evar." The better your rating, the lower your premium. Unfortunately, as far as I can see from my policy paperwork, the ratings don't differentiate between accidents that are, or are not, my fault; an accident is an accident is an accident. Prior to last night I was 5.5 years without an accident and had been in the best category; now that I have one reported accident my "ranking" will drop and my insurance premium will automatically go up.

Yeah, I'd pursue the cops, and make sure that the cop records that she caused it (as in, non-fault), and hit and ran, and didn't have insurance.

Michigan is a no-fault state, so it matters here.

Why would you insurance company even be notified of the accident? If it was her fault, you make the claim through her agency and never have a need to tell them about your company.

Last time somebody hit my wife and I (some asshat rear ended us while we were yielding for a pedestrian crosswalk), we didn't even give him our insurance info. My wife told him flat out that it was his fault and he doesn't need our insurance info at all. He just gave his info and we made the claim through his agency. My insurance was never notified of the accident.

have you tried calling her company to make sure that her insurance is actually expired? esp. since it just expired last week, she may have just forgot her card. i would def. call them up first.

This was deffinately a hit and run. You had to chase them for miles before they stopped. I would try and press criminal and civil charges.

I had something similar happen to me when i had just changed insurances and had had my new coverage for 6 hours. I was stopped in heavy traffic on the freeway and a lady in a 80s cadillac sideswiped me because she couldnt stop in time so she decided to go between myself and another car. She then took off and we had to chase her down off an onramp. Turns out her license was 3x suspended and she had no insurance. She did however have a very high tech/new cellphone and glitzy pseudo status handbag. My insurance paid the damage and recovered my 500 dollar deductible.

And on-topic my experiences with Russians has been that they basically have adopted every superficial, pseudo-riche pretentious aspect of american society. All while working our system for every something for nothing angle they can hit on. All this heaped on with a snotty attitude that honestly wasnt worth going through the whole cold war thing to let them come on over and admit the US is where its at

I got two degrees in Russian Language and Russian History and I already wasnt impressed with them having studied their language and culture.

That being said, all cultures and nationalities have their wonderful qualities and members.. Except for teh OT of course
