Can you link to the actual Flickr page for that photo? Maybe it didn't show the EXIF for a lower res version? I'm not sure...

But yeah if the panning shot was at ***402;5, it's most likely a DOF thing combined with a bit of camera shake. I've had a similar experience with this photo for example...the rear is sharp, but the front isn't because I didn't lead the car enough in my shot...this is 1/160 sec @ ***402;5.6:



But then when you've got it all working for you, even at ***402;2.8 the focus can be spot-on:
