The ATF gets away with this, nationally, because of the 'Inter-State Commerce' clause which allows the Fed to control what goes from state to state, or countryX to the USA.
If AZ passes this law, it will join Montana and New Hampshire which states the ATF (Fed) has no right or jurisdiction to limit, control, whine about, anything that was Made and resides within its state of creation.
So if I made a silencer here in AZ. Used it in AZ and never took it outside of state lines, the ATF would have no say. It would be protected by the Constitution AZ agreed to and signed when it joined the Union in (1912?).
The only thing I Am sure of is that I am no lawyer. You would probably need to be one to explain why this would stop the Feds. in their tracks.
But for those that are confused (rightfully) I just need to point out that this law is almost exactly like Montana's and they have been doing this for some time - Without ATF (or other Federal) interference.

Maybe. But could be like calis weed laws for medical marijuana. You can still get busted by the Feds in Cali even though Cali law says its legal. Who knows, Ill talk to some of the guys at work about it. They know more about class 3 than anyone I know.
