Detroit employee sues city over co-worker's perfume, saying strong fragrance stops her work

DETROIT — An employee in the Detroit planning department who claims she is severely sensitive to perfumes and other cosmetics has sued the city, saying a co-worker's strong fragrance prohibits her from working.

Susan McBride's lawsuit, filed Tuesday in U.S. District Court in Detroit, says the work environment is in violation of the Americans with Disabilities Act. She wants a ban on such scents at work — and unspecified damages.

City spokesman Matt Allen declined to comment, telling The Detroit News the city does not normally comment on litigation or personnel issues. McBride, who joined the planning department in 2000, says problems started a year ago when the co-worker, who isn't identified in the lawsuit, transferred into her department.

"This employee not only wore a strong scent, but also plugged in a scented room deodorizer," the lawsuit states. "Ms. McBride was overcome by the smell almost instantly, causing her to go home sick." The co-worker later agreed to stop using the room deodorizer, but kept using perfume, the lawsuit states.

i work for a planning department (one more day till im gone ), i can tell you they find anything and everything to bitch about, and only do about 1-2 hours of work in an 8 hour day

I can attest that some people go overboard with personal and room scents in the work place, but this woman is just a lazy slob who doesn't want to work, and is looking for a way to accomplish this.

I don't completely disagree with her. Strong scents, just like terrible body odor, have no place at work. But, management should have resolved this before it got to this level.

Yep. Reasonable request...just like I don't like sitting next to someone who stinks of cigarettes, i also dont want to be assaulted by cucumber melon lotion and a glade plug in. Totally should have been taken care of by her supervisor.

Unless of course she decided to stay quiet about it and go over everybody's head straight to a lawsuit. Which is probably what happened. First time the manager's probably hearing about this.

Probably not since the co worker agreed to stop using the room deodorizer, something must have been said.

I could see her request, if she is really that sensitive to certain scents. But it becomes a slippery slope when everyone else has to be inconvenienced because of one person's sensitivities.

It's a lot like the schools where peanut butter sandwiches and any peanut products are completely banned because there might be a kid in the school with a severe peanut allergy. At what point do the rights of one person trample the rights of thousands of other people?

Strong scents ought to be treated just like loud, obnoxious noises; an assault on the senses, potentially disruptive, and something that is not to be tolerated at most work places.

I used to work with a women who's perfume was so strong that I could not be in the same room with her for too long or it would make me nauseous. I can relate, might not pull the lazy card right out the pocket, but I can relate. Also, IIRC this is protected under some sort of law and I remember hearing about similar situations in the news over the years...

I can think of a million people I would rather kick in the **** before this lady...starting with the lady who snapped a pic of the dying lady in the convenience store...

This isn't as bad as $65m pants. People do have serious allergies to stuff, so it's not unfounded. It MAY be a greedy, lazy, WAPCE out to just live off frivolous lawsuits, but it MAY be a serious condition too. Either way, I'd hope she brought it up internally first. If not, then she's the first.

Given my love for peanut butter sandwiches I imagine my kids will like them also. I'd totally sue the school if they said no peanut butter sandwiches. Sorry, but if your little moron kid doesn't know not to eat peanut butter when he is allergic, then Darwin is in motion.

There are people on my floor that bathe in the scents and you walk in to bathroom and it lingers, luckily they arent in my office.

I bet she asked the women to stop wearing it, other women says no and office politics ensue, hence the suite, last resort.

I was at a party yesterday for the fourth and there was about 10 diffent perfumes/ aftershaves mixing in the party, it was a little much IMO.

I think the pants suite was a little more extreme, now this chick asking for money is a little ridiculous also

Eh, I totally love PB, its literally my fav food, but people with peanut allergies can die (throat swells closed) from being in the same room as someone who is/has been eating peanut products, just sucks to be them since peanut oil is everywhere but its not impossible to prevent my asking nicely.

I'm pretty sure our wonderfully corrupt mayor of Detroit has put her up to this. He already uses city funds to buy personal vehicles, take family vacations, and pay for his 21 body guards (why does a mayor need 21 body guards?). He's setting such a great example for those who work under him...


I wonder if his role model / hero is Woodrow Stanley (former mayor of Flint, MI who embezzled $26M during his term).

Um, no. No they can't. You have to ingest it.

While it is true, however, that they can die from ingesting food that has been processed in a plant that also processes peanuts.
