50mph is a really fast speed to take a hit at though. If he had broadsided you dead on at 50mph you would likely be dead.

If it was a direct enough blow to spin you, there would be more damage at that speed and you would have spun more. If it has been glancing, there should be less crumple damage. I'm not questioning you - but others will. If they think your capable of exaggeration, it's going to make the entire process more difficult. Just don't mention your perception of his speed because whether you're right or wrong, it looks as though you're wrong - the damage is what it is.

Yeah, I'm really glad that I wasn't going any faster and that I was able to see him and brake when I did. Seeing him, braking, and then impact had to all happen in a fraction of a second.

My advice was to not mention your perception of the speed as it does not appear consistent with the damage. The damage is what it is. And don't mention the distance traveled. The distance you are clearly unsure of and again, it is what it is. Pull your head in and keep quiet when dealing with any legal matters on this or any claim. After a RTA, people are always looking for a payout. (I'm not saying you are.) As such, the legal system and the insurance companies are always looking for people looking for a payout. Any inconsistencies will be seen as disingenuous - it's just the way of things. So it's best avoided. |

I didn't word my first post well. I was still reeling from the accident. I meant he rolled 100 yards from the point of impact, which is about 70 yards from the concrete median he rolled over.
But, still, I'm wondering how a car could hit another car at 25 MPH and still coast over a concrete median and then coast any distance beyond that, much less 70 yards more. |

FWIW...Stefan's advice is sound.
What's important is consistency, and lack of consistency will break your credibility. If anything, use this as a forum (pun?...nah.) to make sure you know what you know. And lock it into your noggin. What you're saying about being "shook up at the time...sorry I miscommunicated"...that will make a judge/litigation case doubt on the rest of what'cha say. Take it for what it is...I see it as good, friendly, impartial advice. DRum |
