Help dealer has backed out of STI preorder..
I need your help guys,
My dealer, which is Gillman Subaru Austin, texas has just informed me that he is going to markup the STI's and I didn't get anything in writing about mrsp, but he told me that he would stick to his word about msrp the f'ing crook. So, thank god that the deposit is refundable but, I think I need to find another dealership in Texas or the surrounding states that will give me msrp in a written contract. Your help you be greatly appreciated.

Perhaps a call to SOA may help, at the very least put your mind to ease. Also post in the local forum for Texas and they may be able to give you some direction.

i think pretty much every dealer will try to stab some kind of dealer markup no doubt about that. that's what happens when you have a limited production car with a very high demand. this is just dollar signs for dealers. i can honestly say, i would do the same, hey, we all gotta eat right? also, if you think about it, if most dealers wouldn't even sell the WRX for MSRP, what would be the reason that the STi would be sold as MSRP, that would probably be out of the question, especially since the EVO isn't going at MSRP.

If I called SOA what would I ask them? Do they have any control over dealer markups? I am pretty sure that every dealer wants to make the most amount of money possible but, I know of many people in this forum that have written and signed agreements that specifically state that they are getting an sti for MSRP and some people even managed to get it like $400 dollars under MSRP, whatever that may be.

You really need to do some research on Austin area dealers!! GILLMAN IS A CON SHOP!!! thats their bag to rip a new one in everyone I really cant believe their still open
Please help me out on this one cuz Austin Subaru said that they will be marking it up about $5k. So what do u think? |

damn...
i'm number 2 at Austin Subaru. Have a verbal MSRP agreement.
From what some lawyer friends have told me (I've been anticipating a problem based on other dealers marking up) that if they take your money on the dealer's word not to mark it up over MSRP, that in itself is the basis for a contract. You bought the right to purchase the car at the sticker price, if they mess with you, get a lawyer, call SOA daily, etc. (mind you, this is in texas, may vary on location) Kinda like what speedlimit said, this is a form of "bait-and-switch". My salesman is not Brent, but the guy has kept his story straight since placing the order the day the car was announced. |

See I had a verbal agreement with the guys at Gillman but they act as if what I am telling them is absurd. I'll try Austin subie tommorow but, I doubt I will hear anything different from the first time I called them.

I am definitely making calls to Austin subie and SOA tommorow. I am not really sure about an attorney, yet. But after I call those two places tommorow I'll probably call Gillman back and tell the guy whats on my mind...I doubt that will help though.

just be careful what you say to Gillman just in case you do decide to try the legal route.
Make it clear that you only put down a deposit after the dealer agent confirmed that the car would be sold at MSRP. That's what I intend to do if Austin Subaru even tries it. I made a deal. I specifically had a 'gouging' conversation with the salesmen before I would put down a deposit. Did Gillman take your money and fill out a purchase order/agreement? copy your license? We'll they did take a copy of my DL and the guy told me I would have a choice of rim color in a couple of weeks so I think that he filled out an order form, does that give me any leverage at all?
BTW, the situation is that the guy that I put my order with left the dealership and he is the one that verbally confirmed that I will get msrp. |

That doesn't matter...
he was an agent of the dealer at the time.
The purchase agreement thing just helps (IMO) if you do go with a lawyer. It furthers your case when you say you wouldn't have gone as far as an agreement if the dealer didn't tell you MSRP. |

And Id go back and edit all these posts to blank- Just for good measure- Better yet have the mods delete it. Cause if I worked at a dealer my startup page would be the oh so easy to find TX NASIOC to see whose modding racing and what not. Just my.02

Not sure if the law is the same in Texas as it is in Michigan, but a few years back when the T-bird came out a guy had a problem like this. He put a deposit down for two cars at MSRP, of course it was a verbal agreement. The cars came in and received the subsequent markup. The guy screamed bloody murder, even got on the local news, but in the end he lost in court and the cars were sold to someone else willing to pay the markup.

and say you'll pay MSRP it is a contract in Texas. That's it.
Oral contracts up to $5K are enforceable. They made a contract to deliver a car at MSRP. It is binding according to everyone I've talked to. By the way, good luck to the original poster. I hope you get your car! |
