Default CA Modified OR EXESSIVELY LOUD EXHAUST FINE

New in Cali:

They changed the law to allow cops to FINE modified or excessively loud vehicles. $1000 non-correctable fine. I doubt a cop knows what a stock STi sounds like....

Sounds like profiling is now legal.

This is such an over reaction its bot even funny. The only change to the law is that its a straight ticket instead of fix it ticket. The decibels and other details of the exhaust law haven't changed at all.

The law states Modified or Excessively loud.
Doesnt matter if you drive a fart cannon or a stock STi, it's up to the arresting officer if you owe $1000.

I really dont support any blanket law that enables "police officers" to fine you without any way to correct it.
Guilty until proven guilty.

Good for you RobM, I suppose you support "blue lives matters" and killing unarmed 12yr old girls too?

Car guys should support car guys. Not petty theft by cops.

this is in retaliation for all the 'takeovers' last year. doesnt make any sense because all those ******** were on video, it just a matter of logistics to track em down. lazy ass policing just to do a dragnet, punishing people who have no involvement with those incidents what so ever.

Not a moving violation, wont show up as a point.
But you get stuck w/ a $1000 fine.
If its non-correctable, wont matter if you're stock.

Hey everyone,
This post is specific to VC 27151. Or the new vehicle code that has changed the fine structure around a "too loud" or modified exhaust ticket.

The first thing to understand is that this law has existed as VC 27150 since 1977. For a very long time there has been rules on the books that have been designed to keep people from creating unreasonable noise pollution with their motor vehicles. The only part that is "new law" is the fine structure associated with a citation for it. If a citation is written under the new 27151 code, it is not correctable and a visit to a Ca referee is mandatory.

What to know is that it is still 100% legal to modify your exhaust system as long as it is done within the guidelines of the vehicle code that have been around since before most concerned were even born. The loose or easy explanation for this is 95 decibels at 50 feet. Those of you with naturally aspirated cars with no mufflers or resonators at all are way over this, so beware.

The scary part of this that has been circulating the internet for the past week or so is that the fine is $1,000.00. This isn't necessarily accurate as this will be determined jurisdictionally as will the enforcement. It's a bit early to call it, but it appears that this will be a stepped or progressive fine application, similar to the handheld cell phone VC 23123 which increases the fine for each violation in a given period of time.

The other potential issue with a citation associated with this code is the mandatory visit to a referee. Because law enforcement doesn't possess the ability to evaluate what level of volume or decibels your vehicle is making, the ref visit is necessary. Here's where it gets tricky. They do not have a current standardized procedure on how to do this test. The referee has a way to do it, but there isn't (at the time of this post) a current approved SAE protocol on a test that is a fair evaluation. The last one "Measurement of Light Vehicle Exhaust Sound Level Under Stationary Conditions(Cancelled Jul 2007) J1169_200707" was cancelled. The bottom line is they have no way of actually enforcing this with a standardized current test. Imagine if you were able to get a speeding ticket with no vehicle pacing, radar/lidar, or trained estimation of speed proof from an officer. They just thought you were going too fast, it wouldn't hold up in court, and a citation for a modified exhaust that has no current standardized procedure for testing shouldn't either.

Now this won't stop the referee on your visit from finding anything else that is prove-ably illegal like lack of cats, long tube headers, or non Carb approved components, so if you reside in this area you should be very concerned as this can result in some nasty fines.

We've spent the last few days investigating this subject. We've spoken to B.A.R. about the referees procedures around the test. We've spoken to C.H.P. around the way they're implementing enforcement. And soon we hope to have more information from local police departments and other law enforcement agencies. The traffic court interactions will be difficult to determine this early in the game, but we will continue to offer intelligence as we receive it.

If your car (full size trucks and motorcycles do not apply regardless of what you've seen on the news) is super loud and obnoxious, you're probably getting a citation. But if you just have a nice performance set up that sounds good and isn't crazy loud, you likely have absolutely no reason to be concerned. Of course we're happy to help any of you with potential solutions.

That's a muffler tech speaking from a job that relies on modifying exhausts to make a living.
I wouldn't trust his perspective on cops and citations.
I've paid enough tickets to pay for 2 kids to go to college.
More than half was harassment, I went to court for, the Judge sided with the officer.

When it comes to traffic court, you have better chances in a murder trial. The judge will find a way to uphold the fine. It ensures job stability for their work force.

Just my opinion/experience with cops and fines.
Most cops don't even understand the laws they push...

A muffler tech that understands and cites actual resources, and possesses working knowledge of the subject vs. a bunch of anecdotal blanket statements. Yes, I'll sign the petition, but it's not worth freaking out over.

There's a big difference between a tastefully modified exhaust note vs. a straight pipe driving through your neighborhood at wee hours of the morning.

What that statement describes is the correction process for citations similar to this (Non-moving). If the bill makes it non-correctable, then the fine is still imposed despite the smog tech's approval.

Otherwise, the law didn't change and the ticket is still correctable.

What people are forgetting is that this is another reason to get pulled over just for liking cars. The cell phone tickets are supposed to be $25, but I know people have paid $200+

Heres the thing.. I got pulled over for cruising under the speed limit, you could barely here my car at that time (cop had his windows rolled up) and just pulled over for being to ""loud"".. I had been driving for 5yrs with this setup, got speeding tickets n nothing about the exhaust, but randomly get harassed this one time when Im obeying the law n cruising... And for some reason lets look under your hood and oh no carb sticker, let me hit you with a state ref...? wtf.. ? The reason this new law is such a bitch.. before it was a fixit ticket. You dont get pulled over often for just a fixit ticket.. Now theres obvious incentive. If your car is loud, its like speeding now. No more, should I waste my time on just the persons exhaust, I can get money out of it..
Im hearing stock sport cars are getting pulled over and ticketed.. What it does it puts money into the refs pocket as you pay to fight it and pass or the court if you go to fight it.
Its pretty damn close to racial profiling. Its kinda funny how that is.

I dont think you guys are getting it....

There is no need for the officer to use any tools to measure the exhaust level!

The law applies to modified or loud exhaust and intake. That's why I was trying to raise awareness.
