OMGHi2U Need OT's help with a dealership that ****ed me over

Background: I looked at a vehicle at this dealership this week and worked out a deal with the sales manager that was contingent upon me getting certain financing through my credit union. The manager said I could back out if I did not get the financing. Fast forward to the next day and I couldnt get the financing I needed from my bank. I called the manager back and told me they would not refund my deposit. I left a voicemail for the GM to call me back. Waited 2 days....no return call. So last night I dropped off a formal letter requesting to cancel the contract and asking for a full refund of my deposit. Today the GM called me back and said that is the dealership's policy to never refund a deposit if the customer backs out. I mention to him that I bought a brand new vehicle from his dealership a few years back. And that I intend to purchase 2 more vehicles later this year. All he tells me is he can hold my deposit for up to a year and put it towards the purchase of another vehicle. I also let him know that I would file complaints with Ford HQ and the Better Business Bureau. But he still wouldnt budge. Now I realize it was stupid of me not to get it in writing that I could back out if the financing wasnt to my terms. But I still think it's ridiculous that they are losing a one-time customer and potential two-time repeat customer over this, when they have lost nothing.

CN: Dealership is screwing me out of deposit.

That stinks and seems to be a stupid business pratice by that dealer.

Not sure if your in MA, but I'd still attempt something through the BBB, or file a complaint with the state AG's office perhaps?

I'll go down and **** with them in person...it is right up the street from where I work...

I also do not see how it is legal for them to hold on to your deposit...it is now a deposit on nothing, and this is because you did not meet their criteria...sound odd

I once got the cops called on me years ago at Toyota of Nashua for a similiar experience...I started yelling at the top of my lungs in the dealership about how they were screwing me over...the cops told the dealer he should give me my money back and then told me to get out of there before I got arrested....so I feel for you...that sucks...

If the purchase agreement is "contingent" on ANY item, you should get your deposit back.

Research "Mirror Image Rule"

If you gave a check, cancel it.

Usually once Ford HQ gets involved, you'll get your money back.

The NH Atty General office seems to have put on the site that putting a cash deposit down on a car, new or used, won't get you your money back, so don't do it.

http://www.nh.gov/nhdoj/consumer/sou...autos_new.html

Good luck with that.

It's still a poor business practice to lie to your customers. And they will know about it.

This was on the site that KC listed...seems they could be a good place to contact. But also, reading that law it seems that it unclear about the deposit, but I guess since you did not meet their terms it seems like they should be the one paying you back, it's not like you just decided to cancel the purchase...oh well **** them...what do they need with your $ 100...now they have no chance of selling a car to me or the people I will tell to avoid this place...

I worded incorrectly. I couldnt get the financing I wanted. I could get a loan no problem. But not at the rates I wanted.
