Default My buddy's 05 Legacy GT Engine/Turbo failure!! GRRR!!!

Please give any advice if there is any! I feel really bad for my friend cause I bought an 09 WRX and he wanted to join the Subaru family asap...so he bought his 05 Legacy GT mid October...
Please note my buddy brought in his Legacy 1 month after purchasing it in for an oil change AND full inspection to make sure nothing from the previous owner would need repairing...(he has documentation of this) now...3 or 4 weeks after the oil change/inspection this happens:

To Whom It May Concern:

Brought his 2005 Subaru Legacy GT in for inspection on 12/07/09.

Customer stated that the check engine light was on solid.
Customer stated that when the vehicle is warm there is a clatter noise coming from the engine area.
Customer stated that there is a squealing noise when turning the steering wheel to full end and also at times when starting the vehicle.


Technician findings:
No oil was found on the dipstick and no sign of an oil leak under the vehicle.
Found clatter noise due to an internal failure within the Engine Assembly (rod knock).
Found internal failure within the Turbo Assembly.
( Possible Turbo failure causing no oil)

Note: customer has had an oil change service performed at Byers Imports on 11/11/09 at 71,678 miles.

Estimate to replace engine Assembly with a Short Block is $4,750.86 + tax
Estimate to machine Cylinder Heads if needed is $375.00 + tax
Estimate to replace Turbo Assembly is $2,167.50 + tax


I want to say we might have a case to pin negligent inspection and oil change on Byers imports?

They usually kick it to the owner's responsibility to check oil level since it's stated in the owner's manual, but given that it was only 1 month from being bought at that dealership, you may have a case. Did Byer's include some short warranty with the car? It could still fall under that.

It is possible that whoever did the oil change just drained the oil and didn't fill it back up, but the tech AND driver should have noticed this the moment the car was backed out onto the lot ready for pickup/driven away from the lot.

If a turbo is burning up oil the driver should see it smoking - the oil pressure light should have come on also.

Sounds like he might be shiza out of luck, if the car is stock (catback exhaust ok) and has less than 60K on it, it still has powertrain warrenty at the dealership. Working at an undisclosed dealership i also know that if he calls subaru corprate and plays his cards right or just down right bugs the living crap out of them he might have a good chance of getting a goodwill warrenty repair, especially if its close to 60K. Guy at my work had an STi with 62K miles on it and the oil pick up cracked where it bolts to the block! He got a new block, heads, cams, and turbo and only had to pay for labor because he called subaru on it and they are pritty easy to push over. Also it helps to try and get on your service writers good side, if he knows what hes doing he can also help you out.
