Default Subaru Warranty Issue

I have an 06 wrx, and it was approaching 12,000 miles. I don't abbuse it, its never been launched or autox's, just driven to school and work. Well lately the clutch felt like it was slipping so i took it in and they said the clutch and flywheel had gone bad and that no clutch goes bad at 12,000 miles and that it was due to abuse and that warranty won't cover it. Now that car hasn't been abused i have 100,000 mile ext warranty, can they really do this?

Call a lawyer. IF they claim your clutch failed due to abuse then the onus is on them to prove that abuse caused the clutch failure. Stories like this make me not want o buy a subaru ever again. Service dept. is crap!!!!!!!!!!!!

iv'e been driving stick since 16..i'm 20 turning 21 now. I have been driving for a whle, and no i dont ride the clutch or half press it in before shifting. I'll admit i do drive spiritedly at times and other times i baby it., but i didn't buy a wrx to be driven like a grandma. For sure ive never clutch dropped the car or launched at high rpms, and a clutch i dont think, should go this soon, unless you really abuse it like you mean it. They said they wanna do a tear down, but this is b/s, car is not even modded and i would never abuse it.

is this your first manual car? scratch that... i'll give you the benefit of the doubt... my friend has a bmw 330ci and a burned clutch at 1300 miles. her car had some unheard of clutch hydraulic problem which was waranteed.

As far as they are concerned... rally=abuse. The car was designed for road use only. Dig into those pockets and pay to replace it.

Forget the lawyer thing. They only take your money and don't really help. Why spend as much money on a lawyer as it would cost to have it fixed? Your best option is to have them tear it down. They'll likely say that it went because of abuse. Tell them to fix it under warranty. They'll say no. Tell them to fix it so that you can get your car back. When you pay for the repair, write on the invoice that you believe the repair should have been covered under warranty. Go down to small claims court and file a claim against them. You'll have your day in court. This is your best chance. Subaru will want someone to arbitrate it for you. Forget that. They are usually biased in favor of the manufacturer. There are better odds in court. If you can demonstrate that you've driven manual transmission cars previously that have gone much further, that will help.

Also, I wouldn't buy another extended warranty again. As you can see, most of the things that you're most likely to have to repair are considered wear items. Extended warranties are usually 100% profit for the dealerships. The manufacturer makes money on top of that too.

lots of suby dealers hang out here... don't be surprised if they pull out a printout of the threads. thats if they are nice. if they are mean, they will let you go to court first, and THEN pull out the printout.

Seen that first hand... well... presented the info from a different forum to someone about their parking lot donuts and why their transmission which went out on the drive home is not warranty. Even had in print the individual talking about hoping to pull a fast one... This case didn't make it to court once he saw that printoff.

I am assuming that the car is completely stock, you have not taken it to the track, never autoxed it or rallied the auto. My 2005 Stock WRX threw a rod about a year ago and it was completely stock and the dealership told me the same thing, that it would not be covered under warranty. Long story short, it was covered under warranty because they couldn't prove that I abused my car in any way, that it was the car and not me. It was covered under warranty and they replaced my short block. I could have just walked away when they told me it was not going to be covered, but instead I stood there and told them that it fact was covered. Especially if you have an extended warranty. Don't let them just tell you no. Take it to SOA if you have to. If this dealership is not the dealership that you bought it from, call the dealership that you bought it from and tell them what is going on. Call and tell anybody that you can what is happening. If you in fact did not abuse the car and it is stock, then it should be a cut and dry outcome. Warranty work being done by the dealership of your choice.

+1 for SCC, make sure you do as this member says and write on your invoice when you sign it that this was suppossed to be a warrantied item. The rep will probably say you cant write that on there, but go from there right to the courthouse. It might cost you $50 or so to file the claim, then the court serves the order to appear for suit papers to the dealer.
They will probably call you and settle.
Ive done it one time, worked like a charm.

1 Try another dealer.
2 If not lucky, call SOA. See what they say. Also ask them to refund your extended warranty right away. Tell them you didn't pay extra now to hear this same crap 5 years from now. You are very disapointed at their service dept.
3 If they insist on abuse ask them to provide hard evidence for it. A written letter from your lawyer works better for this.
4 Fill out a Cosumer Reports survey and crucify Subaru and it's dealer network.

Blaming everything in abuse is really easy.

You also need to find out for sure who is denying the warranty claim. If it's the stealership, get them to get someone from Subaru of America involved. If they still deny, then that's who you want to sue, not the dealership. The dealership will just try to pass the buck to SOA. If you can get a denial in writing from SOA, that would be even better. Usually, you have the notice of the suit sent to the registered agent in your state for the company that you're suing.

Just accept what you did and move on with it...

first thing people want to do is sue or get a lawyer involved and what not. All I can say is GOOD LUCK. Your going to need it.

Accept what? He didn't do anything to his car, there is obviously something wrong with it. How can you have an attitude of "accept it and move on". All he has to do is get SOA involved and put a little pressure on the dealership (sans lawyer), just like I had to do when I had my problem. If I would have just accepted my situation and moved on with it, my wife would be driving me to work everyday because I wouldn't ask questions and have my fully warrantied, well maintained automobile properly fixed, as it states in my warranty.
