Speeding ticket in AB
I got one yesterday, I had no chance it was laser. One beep on my V1 was all the notice I got. Going 78 on 60 $113. Very surprise and lucky they did't ticket my exhaust/tinted windows and lights. It was my first ticket ever since I first started driving 10 years ago. Is there anyway to "beg for forgiveness?" haha
Anyways how long does it take to get that ticket off my driving record. Thanks. . Byron |

Use Points, I did. Did not take care of the fine, but no points were deducted . They would have gave me my money back if they could not get the ticket reduced to just the fine. Mind you I had a bigger ticket then that, darn construction zones I was furious when I got the ticket as it was just a cash grab really (going from 80 to a 50 with basically no warning).

Ticket will be 3 demerits which will stay for two years, and the record of the ticket itself will stay on your abstract for three years.
The price and demirits will fall if you can get the ticket lowered to 14kms or lower. Better yet, phone Damian. He's had so many tickets, that he'll know what to do. |

I went through this with my last ticket. The cop who pulled me over told me what to do because "you were a decent guy when I pulled you over".
Wait 10 to 14 days so the paperwork reaches the city offices. Then take the ticket in, and go to the counter for "issues"; the one in Calgary was labelled Justice of the Peace. Tell them you want to work something out. Then the ticket goes to the prosecutor, and they call you in for a meeting. They will look up your record to see if you're a habitual sinner. Since your speed wasn't more than 20 over, they will likely waive the points if you pay the full fine. I was also given the choice of paying a partial fine, and getting 2 instead of 3 points. I went with paying the full fine with no points. I was actually 26 over, so I had to look especially contrite. It seems complex, but once I got to the ticket office I saw that they have a system set up for this kind of thing. I also saw no fewer than 16 hidden camera's watching my every move. I guess the city is worried that some people get irate when they get screwed by "the man". I also saw the guy in line in front of me at the cashier's pay $2,500 for parking fines! I guess that was option #3 on the ticket you took right? going to the justice of the peace counter. At the front of the ticket there was a date that I could go. Can I still go in after the 14 days or do I have to wait till the date listed on front of the ticket?? Thanks! |

B, drop me a PM outlining the conditions leading up to the time he handed you the ticket. There are amazingly many ways to get completely abstracted from ever paying a "moving violation" ticket.
As per the "prosecutor waiving the demerits". That officially cannot happen anymore. Some case agaisnt the crown by the "Traffic Safety Board of Alberta" emphasiszed how demerits are the last means left that the boards have to essentially scare driver's into driving more safely. Apparently jail time is not enough of a deterrent, neither were fines so they went up substantially. The EPS is very happy since they get to keep 100% of monies collected from traffic tickets. Long story short - a crown prosecutor is no longer authorized to enact demrit free tickets, only a judge can do that. Now the courts are jammed w/ traffic tickets more than ever. Damned burocracy. |

Bah, I don't know about the Judge being the only one who can change your ticket. I've never heard of that actually. I know that when I got my $267 123kph in an 80kph zone (construction zone too) I called the cop directly a couple weeks later. I didn't have insurance papers in the car (it was insured) and no registration papers, and wrong plate on the car (don't ask, it was my dad's car at the time). I asked the cop if she could change the ticket and ticket me the same as a photo radar ticket. She called the Crown Prosecuter and told him that it was OK with her and I went and talked to the Crown just before my court appearance and he waived the points and I just had to pay the fine.
Also, my brother-in-law's dad is pretty high up in the EPS and he says fight everything in court. He even said to fight photo radar tickets to get them reduced. Go figure. Lots of time the cop doesn't fill out the paperwork properly and the whole thing gets tossed. Fight it BigBear. |

So what is the proper way of fighting it? Goto the Justice of the Peace counter on the date shown on front of the ticket? ie Option 3? This ticket is totally confusing me haha.

I just got a ticket reduced about a month ago. Got a speeding ticket doign 120 in a 100 zone. It was in Barrhead. I called the crown told them my story, they told me to fax them a lterr stating just what I told them on the phone and requesting if they could change the ticket to a registered owners (same as a photo radar ticket) Make sure you follow up that they got the letter and such as they lost my first one. But after they received it the crown office called me back about a week later to let me know it was done.
Went and paid my fine and no demerits on my license. I know if you ask to pay just the fine they are more likely to do it then to try to fight the ticket and get the whole thing thrown out. (was told that by a crown prosecutor) |

With respect Flexx, that was in Barhead. RCMP territory. Not the money grabbing EPS. Sincce my post I have had replies from other ppl saying, "just fight it". Bigbear, I would go to the Justice of the Peace before the payment date & talk to them. It seems that "you never know". If you do not get a satisfactory result from that meeting, it still gives you time (the JP should also offer you this) to have your day in court. This has been well worth it in my case. Most of the time something happens. The officer doesn't make it or gets a fact wrong or something. Anything that may work to your advantage. Plus, in your day in court, you can still plead w/ the Crown Prosecutor & if it comes to it, the Judge. If they see that someone w/ thier first speeding ticket ever is incensed enoug to fight it, they may help you out. Plus your a nice guy (unlike me) so that will help you.

do EPS and RCMP tickets put different demerits on your record? or is it all one and the same - just different uniform/badge as far as tickets go?
