Domain registration, ownership, legal recourse question
A company hired my services and company to do work for them over the past two years. It was a startup and one of the things we did was register a series of domains for them. They were purchased by me and i was reimbursed and they remain in my account. Now that I have ended the engagement who actually owns them?
They have no access and I am going to transfer them to the company, but who legally owns the domain? And if I redirected it, would i be help liable?

Typically, work for hire is owned by the person doing the hiring, not the working. Also, if they paid for the domain by reimbursing you for it, then they should own it.

if you bought them under their direction while you were under "contract" with them, and they then paid you or reimbursed for them the domains are going to be theirs.
Dont be a dick, even if they are being dicks to you take the higher ground and act as if you were a professional. |

It depends how the contract was written. If you wrote it in there that it's licensed and you own it, good for you...you caught them slipping. But it's bad business.
It's one of the things I look for first when working with ad agencies, domain and IT developers for whatever app/website/dev/source is owned by the client. If I see any type of wording that even hints at proprietary stuff from the contractor I get it squared away before anything is signed. The only time you have leverage is if it's a market changing platform. |
