Default Insurance company wants to use a used tire

My girl crashed the STi, insurance(progressive) is paying to fix it. when they did the original estimate they "didn't see any damage" to the wheels, mind you most of the front drivers wheel's face was scared up, and the rear drivers tire has a huge scrape on the outer edge. I called them and got them to cover the front wheel, they missed the 2.5" long gash on the sidewall, so i called my adjuster back and got no response for over a week.
I called her supervisor and within 2 hours got a call back from someone else. They said that the adjuster found no damage to the tire, I argued back and told them to contact the shop haddling the claim so he can confirm.
They said that they would and if indeed there was a slash they would pay to replace the ONE tire with get this....... a USED TIRE. I reminded them of the fact that the vehicle is AWD and that if the circumferance is too far off it will cause damage.
He said that they would ensure the same type of thread, and if they could not find a used one similar to what i have they would buy ONE new tire.
I then proceeded to remind him again that if it is too far out of spec it WILL cause damage to the diff. He said that I would have to pay for the other 3 tires because they were not damaged in the accident.
Are they allowed to do this??? in a few months when my diff heats up and breaks do i have the right to claim it?

order a new tire from tirerack and have them shave it down. stop trying to get more than you deserve from the insurance company

I think most insurance companies will try to nickel and dime you out of every repair they can but I have heard Progressive and Geico are the worst when it comes to things like this. Giant faceless and heartless corporations with the lowest rates will always screw you in to oblivion.

Like IIdiceII said, have the tire shaved to your specifications.

This is one of the cruddy things about Subaru AWD. No different than getting a unrepairable flat. At least you only have to pay for 3 out 4 .

I can third that one. I've had tires shaved through tire rack. They do an excellent job, and they're one of the only places that still does it.

ok ill lok into shaving the tire, luckily they still have some of the same tires in stock(discontinued)
the other issue is that they are paying a depreciated price for the tire.

It's a pretty frustrating situation, but the insurance companies obligation is to repair/replace what is damaged. If they write the tire off they will prorate the value based on used tread depth. I understand this isn't what you want to hear but you have a damaged used tire, not a new one.

If they can find you a used version of the same tire with similiar wear (doubtful), why would you be upset? Seems like a good solution. Otherwise a new tire from TR is the way to go. They used to only shave R compound, glad to see they do regular tires now.

Im not sure what the cost is for the general public, but the wholesale cost to shave a tire was exceedingly negligible. My heart still felt sad shaving 40 percent off a brand new tire on the last winter tire I had done.

My neighbor went through the same thing with his outback. He finally got them (commerce) to pay for 2 of 4 new tires. Not good but not bad either, 4 tires for the price of 2. I'd give it a shot.

Ouch that sucks. You just gotta kinda keep arguing with them. When a woman hit my Nissan her insurance company basically tried to underwrite the damage and say that this and that wouldn't be covered. I didn't even argue with them, the shop I took it to basically said that they'd "take care of the insurance company" for me o.o

I wouldnt have a problem with them finding the same tire used as long as it was with in spec, but what are the chances of this? slim at best.... maybe i can get them to purchase 4 matching used tires??? Itll be cheap....
this kinda concerns me cause we still havent even gotten to the suspension, they said that they will take it to get aligned and if something is wrong they will then "figure it out" problem is i have coilovers idk if they will some how try to shaft me because of that. We'll just have to wait and see, thatll be next weeks battle, last week was the wheel....

I think that if you want things to go well, you're going to have to offer a compromise. Maybe have them pay for one tire and mounting costs. Then buy a full set of what you want from Tire Rack and mount them. Sell the leftover 3 tires on Craigslist or Massdriven or NEMS or even here.

I needed one snow after destroying it last spring and bought 2 (including one spare wheel). In my case, the tires had hardly any miles on them.

I work for insurance companies, and let me begin by telling you that Progressive insurance is one of the worst insurance companies out there. One thing is they cannot use a used tire on their estimate. That is against MA Law CR212 & 211. They cannot use used suspension parts of tires.

What they need to do is pay for a new exact tire like the ones you already have. Then they need to take a betterment (depreciation) on it for the amount used. If you need further help with this feel free to PM me, I would love to show Progressive employees how to work. Its what I do for work all day everyday.

Also do yourself a favor call another insurance company, leave Progressive because in the end you always loose. GL!

thanks for the tip. ill make sure i relay the info. ive had progressive for a little over a year, and have had 3 claims, they have been good until now. I normally just bring it to F&S auto in sutton and Theo takes care of them, this time they sent a different appraiser than usual, and she is a lazy bitch, and has treid to over look a few things.

Is it really that big of a deal? My track tires on the STI's wore at different rates depending on the course. I doubt they were at even tread depth except when I just got them, although I did rotate them to try to get even wear. I didn't blow any diffs.

OT:

Progressive has been fine for me but only two stupid claims on my part. Tricycle fell on front fender and WRX rolled into car due to poorly adjusted ebrake cable.

I tried other places but they are about $300-$400 less than other closest cheapest quote. Over 10 years with Progressive that is $3000+ in savings.

To each their own, buying (and mounting) three new tires out of pocket instead of having one shaved down sounds ridiculous to me. Those costs will not be covered by insurance.

OP: if you have suspension damage they will replace those parts as well. If you have aftermarket parts they will need to replace with the same parts. The googd news is aftermarket parts are almost always cheaper than OEM. Try pricing out an OEM wheel or stereo, $$$.
