And how far that piece extends (to me at least). If it's a structural bracket that just spot welds near the bottom of the trunk it can likely be drilled/replaced, if it's attached to a larger folded piece that's integral to the struture or a major assembly, I'd want the whole car replaced.

All great questions. The brace starts there and goes into the fender. I am not sure in inches how far that is, but it is a much bigger part than I was originally thinking it was.

Yes but you're just talking about the very end of it. Hell, welding in a new section would make it stronger than it is.

Again, besides some mental block that your car is "perfect", there's no downside to have them repair it if the history stays clean.

That's not what I thought lemon laws were for. For one, this can be repaired (easily), which right away takes it out of the lemon law arena. Again, agreed.

I'm fairly certain that he could continue to drive that car for as long as he owns it without any noticeable effect caused by that defect.

Maybe I'm in the minority here, but I would chalk that up to "**** happens" and "it's something I can live with", provided it doesn't affect the performance or structural integrity of the car. Maybe I'm more laid back than most, but I never understood this "everything has to be absolutely perfect or I'm going DEFCON 3 over it" mentality. What are you going to do when you get your first door ding?

Honestly, you're probably going to create a bigger headache from whatever that body shop inevitably effs up in the process of fixing that little defect, than the defect itself. Isn't that white paint notoriously difficult to match?

I understand what some of you guys are saying, but if when I buy a new car I want it to be perfect. If its not perfect then it better be used for a lesser price. A new car shouldn't have chit like that. You guys are just willing to accept something less than perfect. Thats one thing that's wrong with this country

Looks like he wont be winning any awards for stereo competitions soon....not untill that metal gets reworked. Thats the first thing i do to a vehicle when i get it..install some sort of bass in the trunk. If i popped the trunk and saw that..............id be pissed!!!!!!!!!!

No, we all want our new cars to be perfect. The difference is, we all understand that **** happens. Sometimes big ****, sometimes small ****. Being willing to get over small ****, and come to a reasonable agreement with that in mind...that's what this country needs.

To the contrary, I'm think what's wrong with this country is the fact that one would even consider getting a lawyer, and suing over something so insignificant it's not even funny.

I think people being anal about things that are completely irrelevant to ones use and enjoyment of a car are what's wrong with this country. Like owners on a BMW board, stereotypically. Bitching over the smallest, stupidest thing because their car isn't "perfect".

Anyway, I'm not saying that is the OP. Clearly, there's a defect. I'm just saying I'd certainly be entertaining offers to fix the car, plus free service, etc., bearing in mind that little fbit sheet metal is of no importance what-so-ever, nor really even visible.

No question about that.

The question is, if you don't get perfection, how do you react?

If it's something that permanently affects the car in a meaningful way, I would think your reaction would be different than if the if it's something which has absolutely no effect on the car.

The difference between you and me is I want to receive what I paid for and you are obvously willing to accept less as long as you are compinsated. Kinda like settling out of court... Again, what happens if the same machine that f'd up that part f'd up something important like welds in a crumple zone... F free service

Quality control is never going to fix 100% of potential issues. If it's significant problem, then the manufacturer should take care of the issue. That said, I am having a hard time seeing why this is a big issue. The pictures make deformed part look rather insignificant (new piece, and call it a day).

I opened this expecting to see crushed fender or something integral to the car? I know it's upsetting due to being a 'new' car, but anything they cut or weld and re-paint will not be noticeable by anyone unless they are planning to live in your trunk and are intently looking over their new 'ceiling'.

Just get them to fix it and move on, I can't see anything that would be impacted by that part not even being there. It's just the final metal flange attached to some other part. Hell the gauge of steel is so thin it's probably not doing anything at all even on a perfectly built car.

Good luck, but I dunno... seems pretty extreme raging for a new car over it. <shrug>

What baffles me is how the technician doing the PDI missed that. Either the person examining the car missed it (Don't quite know HOW you would miss it.), or saw it and neglected (Or was ordered to ignore the damage by management.) to note it on the RO.

I would definitely ask to see the PDI worksheet the technician filled out prior to anyone purchasing the vehicle. If it's given a clean bill of health on there, you have another strong leg to stand on.

I am a technician at a KIA dealership and are supposed to run a "fine thooth comb" through damn near everything to make sure there's no damage to any component.

And....

If I were to miss something like that the dealership would have to almost quite literally bend over and make it right. No matter the cost. Your dealership should be no different.

Good luck with everything. I'm interested to see how they handle the rest of this.
