I got a speeding ticket but he filled out the ticket wrong..can I get it nulled?
So I got a speeding ticket and on the ticket is a space to fill in the info for the driver and also for the vehicle owner
On the section for vehicle owner he checked the box 'same as driver'...BUT...my dad is the registered vehicle owner...it's just that my middle name is my dad's first name so the officer probably got that mixed when looking at the vehicle registration and my license. Also the field 'evidence of financial responsiblity' he left blank and he didn't ask for my proof of insurance... Is it possible to get out of it?

He's not required to ask from proof of insurance to give you a ticket...
And no... you're not going to get out of it because of that... |

He cited me for CVC 22350 Basic Speed Law:
"22350. No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property." Not (CVC)22349(a) (exceeding the maximum speed limit) hmmm |

You people are stupid... Based on that ticket, the cop did nothing wrong...
There's a hundred different ways to write a ticket for the same thing... But if it makes you feel better, analyze the sh** out of it, and go into court with a bunch of ideas that people in the net told you to try... |

You could use the angle that he made a mistake when he filled out the ticket, so clearly he wasn't paying attention to some documents that were right in front of him, how well could he have been paying attention to a radar gun and your car?

1) weather was clear
2) visibility was good 3) traffic was light..there was no cars in front of me 4) road surface was fine 4) there were no persons of property in danger... so..it seems that section of the vehicle code he wrote in the ticket need not apply? |

Take it to court anyways, I bet they will atleast reduce the fine, and hopefully the cop will not show up that way you can get away completely free (my mom was lucky enough that the cop did not show up and the ticket didn't affect her at all)

Yes, always atleast take it to court, they're more likely to reduce it if you show you're serious about fighting it

You have the cops name. you can find his adress and phone number. Send him some threatening (sp) mail. And some Phone calls. Tell him "If you show up, You will never see anything ever agian!" then evil laugh so he knows you are serios.
And if that doesnt work. Then go to his house <Insert ideas here/>... That will make him not want to go to court. |

you can get out of ticket for things like forgetting to fill in the date of the offense... forgetting to ask for proof of insurance isn't going to do it for you.

Sounds like you're boned. The officer didn't ticket you for something you can factually or "by the numbers" contest, like speed limit or running a red. He ticketed you for "I think he was driving too fast for conditions." If you go to court all he really has to say is "I believed he was driving too fast for conditions" and it'll stick. In fact, the fact that there was little other traffic will tell against you; you can't claim you were keeping up with flow of traffic if there was no other traffic. Also, by your own admission, what traffic there was was behind you, so it sounds like you were driving faster-enough than traffic to draw the officer's attention.
To repeat: if the officer wants to make it stick, he will. DjB |

i had a cop who gave me a court date that didnt match the listed day of the week...call the da and see about getting improper equipment and payin your fee (however much court costs are)
