Default Help!!! Dealership damaged car!

Hello everyone, I was wondering if anyone had any advice or or knowledge to help me. My wifeís car was flooded due to the terrible storms here in PA. So yesterday I spent all day at a Acura dealership working out a deal on an Acura MDX. I signed all the paperwork and left it to be picked up after detail Monday afternoon. My wife wanted to see her new car today so I loaded the family up and drove to dealership and started looking at it. I noticed that the passenger side wheel well was protruding outside the body. Further inspection I observed fender and bumper damage along with white paint transfer in the headlight. Looking over the rest of the car the rear bumper was pushed into the quarter panel with scratches. Now parked on each side of the car was a white MDX and a white rogue. I signed all the paper work however didnít give my down payment or take delivery. Am I forced to take delivery of this car with them fixing and having a new car with crash on its carfax?

I don't know what you are forced to do but if you are paying for a car that was not in an accident and since then it has been I think you could refuse that car and ask for another one undamaged.

How sure are you that the car you saw was the one you bought for your wife?

100% sure. I looked at the vin since I had the paperwork and it matched.

refuse the car. in no way shape or form take possession of that thing. you are paying for a new car, you havent taken possession of it yet, they need to provide you with a new undamaged car, or a 100% refund.

Did you point out the damage to the dealer while refusing delivery? Your post doesn't say if they indicated the car must be taken as-is or something like that. If they had a parking lot mishap of some sort, I would think an Acura dealer would make it right and put you in a different car. If not, take your business elsewhere.

Agree here. Iíve refused a car after signing.

then you pull the, i signed for a brand new undamaged car, and you will get no money unless you deliver a brand new undamaged car.

You signed for a new undamaged never damaged car. Of course you don't have to take it. Expect a call this morning from the dealership explaining the situation. Hopefully they can offer you another one that is similar and better equipped for the same price or an identical one and include some accessories on the house.

Of course you can refuse the car.

Refuse the car and DO NOT let them fix the damage on the car and give it back to you.

You do not have to take it. Tell the Dealership you want a brand new replacement car, if they even have one you like or tell them to return your money in full and take your business elsewhere.
