Default warranty issues, someone help

i need some help guys. my mom has a 2007 subaru wrx. 5spd. this is my moms car. she drives it like a grandma... it hasnt really ever been ripped on. her tranny started grinding so i took it to the dealer thinking they wouldnt try and screw me over as bad as a lady. they came back saying that since i drive it sometimes i must of been abusing it and they want to split the cost 50/50. there is no reason for this, subaru needs to pay for the whole thing, its not like this car has been getting raced and abused. ive had my battle with dealerships and warranty work over aftermarket parts. but i dont have anything to back this up when it comes to a 5spd tranny showing signs of abuse.

anyone got any brite ideas so i have a leg to stand on when i take this up with SOA?

That makes no sense. It almost sounds like they plan to bill SOA for the full repair cost as allowed by the policy, plus garner a little extra from you. I mean they would have had to have talked to the regional rep to come up with a deal like that. This just does not sound right from what you've said so far.

they are getting me a list of broken parts right now. but from my knowledge im guessing a gear broke.

ive been told SOA is the one who gave me the deal of 50/50 and if i wanted to fight that i needed to take it up with them. everything does sound pretty fishy. i dont know.

but i know there has to be some solid paper work or a law i can throw in their face, im just having a hard time finding it.

you should never have taken it in, if you are young. They most likely would have replaced it no questions asked if it was your mom bringing it in. I think it would also be a very valid argument that why in gods name would you need to beat on your MOMS wrx if your driving a STI...that just doesn't make sense.

I think I did see something on www.endwrench.com about warranty issues if they figure the car has been 'abused', particularly involving wrx's, so that might be where they came up with this idea.

Seems to me that they would have to PROVE that the car was "abused" rather than merely suggest that it *might* have been.

they do. but with broken parts, they are saying its from abuse. i can walk in there and say prove it. but its not going to get me anywhere. i need something to stand on and fall back on to throw in their face. a writen law that says they have to prove it or something that defends me. something besides my self. your talking about one person vs a large company.

It is true that they have to prove that abuse caused the failure in order to make you pay for the entire repair. It looks like they are trying to help you out by splitting the cost with you, as a goodwill gesture. Broken gears are, unfortunately, just that though, abuse. It has been proven over and over and there is a service bulletin to back this up.

I would take what they are offering you. People have tried to fight this in a court of law and lost, plus had to pay Subaru money.

Its true! I've seen the bulletin. It has pictures of what an abused trans looks like on the inside. Trust me, take the 50/50 and stop beeting on the car. I tried to get mine warrantied and the only thing that was wrong was a few teeth were chipped out of the final drive gear. They told me that I had the wrong fluid in there. (wrong!) I spun the car out in the rain on a racetrack and didn't push the clutch in going backwards in 3rd gear at 60mph. That was enough to do it. I took the 50/50 deal. Or you can pay your 50% then take them to small claims court and try to get your money back. Good luck.

looks like your "mom" doesnt know how to drive stick. if gears are broken or teeth are missing, you are very lucky SOA has offered to pay 50% of the repair.

I work for a dealer and in the last three weeks I've rebuilt three 5-speed wrx trannies. Gears 2-3 on one 3 on another and 4 on the last. The thing is, I've done all three under warranty. SOA will repair the car but will give you a 'one time freebie' if you will. You sign, and if the vehicle ever returns for the same repair, it's all on the customer. We even had one kid who when asked if he was racing when the trans let go replied, "not at the time." Idiot. The thing that sucks is subaru warranty only pays about 6 hours to pull it, split it, rebuild it and put it back in. Sucks.

Actually, you're the one who looks like a "****ing idiot" and should "feel dumb" given your posts here, like this one:

The dealership obviously wasn't trying to "target women" and wasn't a "scam artist."

Maybe you'll crawl back under your rock, now.

Wow....your dealership works fast

Last night, you were PO'ed that they were scamming you, yet at 4;30 today, the car is fixed.

Ask their technicians if they are looking to relocate to Florida......

yep, thats why they try to not warranty it. it doesnt pay. I work at a toyota dealer and we treat our customers like kings lol after getting a big hassle yesterday about 1 leaky strut I went back to work and told the service writers how awesome they are compared to the automall. Everywhere is different...oh btw our toyota rep came in and told us if we see a guy with an FJ cruiser doing burnouts and rollbacks or anything and he breaks something its warranty no matter what. just a little heads up

oh and from my experience the writers dont target anyone. little old ladies get the most free stuff second to girls showing cleavage with a sweet butt and everyone i work with in the shop is decent person who knows the value of a dollar, they dont rip you off,we just tell you what you need.

But...we dont have fast cars either so we dont attract this type of crowd,my customers are concerned with safety and gas mileage yuk lol

oh and mike we get 6 hours to just swap the entire unit :P nana
jk- id love to work on scoobys at a mod freindly dealer like Metric on long island. whats it like working where you are??
