warranty issues, someone help
i need some help guys. my mom has a 2007 subaru wrx. 5spd. this is my moms car. she drives it like a grandma... it hasnt really ever been ripped on. her tranny started grinding so i took it to the dealer thinking they wouldnt try and screw me over as bad as a lady. they came back saying that since i drive it sometimes i must of been abusing it and they want to split the cost 50/50. there is no reason for this, subaru needs to pay for the whole thing, its not like this car has been getting raced and abused. ive had my battle with dealerships and warranty work over aftermarket parts. but i dont have anything to back this up when it comes to a 5spd tranny showing signs of abuse.
anyone got any brite ideas so i have a leg to stand on when i take this up with SOA?

That makes no sense. It almost sounds like they plan to bill SOA for the full repair cost as allowed by the policy, plus garner a little extra from you. I mean they would have had to have talked to the regional rep to come up with a deal like that. This just does not sound right from what you've said so far.

they are getting me a list of broken parts right now. but from my knowledge im guessing a gear broke.
ive been told SOA is the one who gave me the deal of 50/50 and if i wanted to fight that i needed to take it up with them. everything does sound pretty fishy. i dont know. but i know there has to be some solid paper work or a law i can throw in their face, im just having a hard time finding it. |

you should never have taken it in, if you are young. They most likely would have replaced it no questions asked if it was your mom bringing it in. I think it would also be a very valid argument that why in gods name would you need to beat on your MOMS wrx if your driving a STI...that just doesn't make sense.

I think I did see something on www.endwrench.com about warranty issues if they figure the car has been 'abused', particularly involving wrx's, so that might be where they came up with this idea.

Seems to me that they would have to PROVE that the car was "abused" rather than merely suggest that it *might* have been.

they do. but with broken parts, they are saying its from abuse. i can walk in there and say prove it. but its not going to get me anywhere. i need something to stand on and fall back on to throw in their face. a writen law that says they have to prove it or something that defends me. something besides my self. your talking about one person vs a large company.

It is true that they have to prove that abuse caused the failure in order to make you pay for the entire repair. It looks like they are trying to help you out by splitting the cost with you, as a goodwill gesture. Broken gears are, unfortunately, just that though, abuse. It has been proven over and over and there is a service bulletin to back this up.
I would take what they are offering you. People have tried to fight this in a court of law and lost, plus had to pay Subaru money. |

looks like your "mom" doesnt know how to drive stick. if gears are broken or teeth are missing, you are very lucky SOA has offered to pay 50% of the repair.

I work for a dealer and in the last three weeks I've rebuilt three 5-speed wrx trannies. Gears 2-3 on one 3 on another and 4 on the last. The thing is, I've done all three under warranty. SOA will repair the car but will give you a 'one time freebie' if you will. You sign, and if the vehicle ever returns for the same repair, it's all on the customer. We even had one kid who when asked if he was racing when the trans let go replied, "not at the time." Idiot. The thing that sucks is subaru warranty only pays about 6 hours to pull it, split it, rebuild it and put it back in. Sucks.

actaully you ****ing idiots giving my mom **** about driving, i hope you feel dumb now. lol. subaru fixed everything for free and apologized after they found the problem where a bolt or some**** had rattled loose and caused the damage. atleast they fessed up and fixed it. i wasnt on here trying to hide anything from anyone just looking for help. if u dont want to believe the whole story then dont ****ing post on your dumb assumptions lol.
