Who knows. But the "wasn't technically driving" bit won't actually fly and any decent lawyer knows that.
He was in control of the car...not going to get off, for that reason anyway. People have actually received DWIs for being drunk while working on their car...not even running. Same thing for people that throw their keys out the window and try to sleep it off in their car.

Gotta love the NASIOC Luddite Brigade.

There are already autonomous busses doing fixed routes in Asia and Europe.

Waymo became a public autonomous taxi service today.

Weather is a problem.. but it's not unsolvable. This technology is going to be perfected and tuned every day by thousands of people.. your naysay from your engineering armchair can't compete with that.
