Merging??? Onto the freeway? Why not give him room to merge? I see this all the time (also happens to me), people will speed up just to keep one car length ahead. Why not slow down and let them in, it will make traffic flow smoother, and you don't get into situations like this. Not saying your guilty of this...just wondering the entire situation. Also, i try to stay out of merging lanes unless i really need to be there.

so lemme get this straight... you're gonna look for a limited edition yellow wrx with a cali license plate in california, find the owner, ask for insurance, have an argument or maybe even get a black eye from it, and take them to court on grounds that his yellow limited edition car made you crash and win? Good luck, save the legal money for a down payment, cuz without a plate number... you lose. **** even with a plate number you will lose, on grounds that you should have slowed down in a situation like yours, instead of moving away and causing another potential accident.

ill tell u this now, since i work with insurance claims for a living... you're gonna get 0 (zero) dollars by filing claim/suit. first of all, the identity of the yellow wrx cannot be confirmed, its purely allegation at this point. for all anybody knows, u ran over a tire or a ditch and flipped over on the side of the road. i mean hell, the accident could have actually been your fault, theres just no way of telling in a 1 vehicle accident. whether or not you have a witness is irrelevant without a police report that can confirm that the yellow wrx was involved. second, since it is a single vehicle accident with no bodily injuries, all you're basically entitled to is property damage liability, which doesnt amount to much more than the actual damage to your car. but in some cases you're gonna end up with less than actual damage since they might find a percentage of comparative negligence on your part. ur actually better off suing the city for a pothole or an obstruction in the highway but im assuming you already blamed the yellow wrx in the police report when the accident occurred.

i read a lot of stories like this one. to me it sounds like ur classic case of wut i call lane hogging. basically, the yellow wrx wanted to get in, volvo guy here didnt want to get cut off so he gooned the lane. subsequently yellow wrx probably got pissed and wanted to return the favor, so he guns it to get ahead in an attempt to cut off the volvo. volvo guy wouldnt have that, so he runs with the wrx until he gets edged off the road.

after analyzing the photo of the accident, it seems like this was no 70-80 mph occurence. probably more like 90-100mph+. ive only been doing this for the past 2 years but normally, vehicles shouldnt lose control in such a way at cruising speeds. the damage to the front and the fact that it flipped completely over is an indication that 1) either the vehicle was being driven at an uncontrollable speed or 2) the shoulder of the road was defective. if it was the latter, then u have the right to sue the city. they may not be found entirely liable if at all, but atleast you'll have a case and a deep pocket to dig into.

1 thing that the volvo should have done was slow down the second he decided to shoulder it.

UMM Why didn't you just honk at his ass. I had the same thing happen on I-5 and i was on the right lane next to the guard rail scared the crap out of me but I honked and he backed off. And we where going bout 60 ish..... .

Yes, no contact = one car accident. Its the same as if you swerve to avoid an animal and you total your car, its your fault. If you actually hit the animal, then insurance would cover it. In the future, let them hit you.

If they hit you and don't stop, you have to file a police report within 24 hrs or there is no coverage with most carriers. Insurance is a contract and the words that we never read can haunt us
